Sold car without notification

Capital One Auto Finance sold my car with out informing me. I was 45 days late on my payment and they started calling my job and cell phone every 15 mins. (claimed system issues) I surrended but explain to rep that I wanted my car back but I could not take the 2 weeks of harrassing calls to my job and home. (one rep told me to work the street or if i owed my home i should sale it and stay in a homeless shelter, paying capital one was the right thing to do).

Two weeks after they pick up the car in front of my home they sold my car at auction for $4000 and the trade in value $9000. I never received anything and had made 1/3 payment two days before auction. Capital one claim they did not have my address. They picked my car up in from of my home. The towing company knock on my door to get the keys.

Capital one is demanding over $10k to settle account. There is a law they states that a creditor must informed the consumer that the vehicle is going to be sold at auction. I was not informed I cant sue but capital one auto can sue me after they broke the law.
