We took our truck to have it repaired at KMI Auto Body Shop located on the 4244 block of Pecos Road, North Las Vegas. We dealt directly with an individual by the name of Roger Hernandez. State Farm Insurance paid for the towing of our truck. State Farm Insurance sent a PD adjuster to KMI to approve the estimate on December 28. The estimate was for $3963.65. KMI Auto Body Sales Shop then submitted a supplement requesting additional funds on January 11. The estimate at that time was for $1,917.39. The truck was not ready until January 30. We took it out but noted irregularities with the paint job, particularly bumps that could be seen and felt if palpated. The back of our truck was uneven and we immediately brought this to the attention of the body shop attendant, Mr. Roger Hernandez. Mr. Hernandez assured us that there was poor visibility inside the garage, but once we took it outside, we would notice there was nothing wrong with the truck. We took the truck out of the garage and it still looked uneven. As we test drove the truck, we noted that it was making a very loud noise. Within a few days of driving our truck, we noted the following issues:
1. The muffler was hanging loose
2. The rear hatch was crooked
3. The brakes were making a lot of noise
4. The headrests were still deployed from the airbag inside them popping
5. The reverse lights did not work
6. The left turn signal and brake light did not work
7. The check engine sensor was on
8. The alignment was off and the vehicle would veer to the right

9. The paint job was bumpy and rough on the rear hatch door as well as the entire rear drivers side and the front bumper
10. The gas tank was not secured so when we opened the gas tank door the gas tank would move around
11. The gas tank nozzle was depressed in so that you had to reach in the fuel door to grab it and secure it so that we could put gas in the vehicle
12. Only one rim had been replaced of the three that were billed to the insurance
13. The suspension was acting really weird and the rear driver side wheel was tilted inward.
We started calling Mr. Hernandez on 2/1. We called him 12 times over the course of 3 days until he agreed to take back the vehicle and fix vehicle again. We met Mr. Hernandez on 2/4 at KMI AUTO SALES BODY SHOP and we detailed all the things that were wrong with the vehicle. Mr. Hernandez was very agreeable that it was unacceptable workmanship and agreed to fix the vehicle and agreed to fix all the problems. KMI AUTO SALES BODY SHOP took possession of the vehicle on 2/4. KMI AUTO SALES BODY SHOP received its third payment from State farm in the amount of $1884.57 on 2/9. We stayed in constant communication with KMI AUTO SALES BODY SHOP through Mr. Hernandez to check the status of the vehicle and to see the progress of the repairs. We took additional photos on 2/6 and again on 2/25 of the vehicle repairs.

We contacted KMI AUTO SALES BODY SHOP on 3/6 and were informed the vehicle would be complete the next day and that we could come in to pick it up. We called KMI AUTO SALES BODY SHOP 3 times on 3/7 and left messages regarding when we could come in to inspect the vehicle. On 3/7 at 450pm we received a call that the vehicle had been left in the parking lot of Tanyas job. Upon seeing the vehicle that evening it was obvious that the vehicle was not repaired correctly yet again. We started contacting KMI AUTO SALES BODY SHOP at 806 A.M. On 3/8 and he would not answer our calls. The issues with the vehicle were as follows:
1. Paint job still bumpy and rough on the entire drivers side and the front bumper
2. Rear hatch door was crooked
3. Rear driver side light case was crooked
4. Rear bumper crooked
5. Check engine light still on
6. Driver side rear wheel still tilted inward
7. Passenger and driver seats shake because they are not bolted in place properly.
8. The glass in the rear hatch was rattling as well as the windows on the drivers side.

We first thought the vehicle was safe to drive and that most of the remaining repairs were
cosmetic but as we drove the vehicle it was obvious this was not the case. The vehicle made a great deal of noise that could only be described as a box or rocks shaking around. We contacted State Farm on 3/14 to ask what we should do to get our vehicle repaired and we were informed that there was nothing they could do to help us. State Farm will not guarantee KMI AUTO SALES BODY SHOP work on the vehicle and they had already paid for the repairs and so they had met their obligation. We then contacted our own insurance company Geico and they stated that they could not help us either because State Farm had accepted responsibility for the damage and that Geico was not responsible for helping us deal with the situation. I informed both State Farm and Geico that the vehicle was not safe to drive and they apologized that I did not have a vehicle to drive but that it was not their problem. As of 3/15 KMI AUTO SALES BODY SHOP denied to do any more repairs to vehicle and stated that they would not guarantee their work.

We made several attempts to get the shop to correct the issues with the truck. These were issues we never even present before we took it in for repairs from the accident. The last attempt we made was in March 15. The body shop told us they did not guaranteed their work.

We took the vehicle to a reputable body shop and they began assessing the damage still present on the vehicle. They found an additional $4454.18 worth of work to be completed. This is total of 81.5 hours of labor to be completed. We were shocked to find out that parts that were supposed to be replaced by KMI AUTO SALES BODY SHOP were never replaced or even repaired. The new body shop also found the use of duct tape to hold parts of the frame work together!!!

We have spent hours contacting agencies all over Nevada to see who can help us with this situation. Jim Marsh is currently repairing the vehicle and states that we can make payments on the repairs but Jim Marsh cannot return the vehicle to us until payment is received in full. Therefore we have no vehicle and we are looking at a $5000 bill as well as the fact that we have to continue to make monthly payments for the vehicle.

We have also since learned that KMI AUTO SALES BODY SHOP is not licensed as an auto body shop in Nevada they are only licensed to sell used vehicles. They do not have a license for their garage as well. We do not want KMI AUTO SALES BODY SHOP to be allowed to continue to take money from people who are vulnerable because of a car accident. They received total payments of $7765.61 to repair our vehicle and to replace parts and instead they did neither and kept the money and that is wrong. We need help.
