Tres Hermanos Auto Sales
Deceptive practices, odometer fraud, and stripped cars

This dealer is a crook and a fraud in every sense of the word. They advertised a 2004 Hyundai Accent on Craigslist with 70000 miles for $3700. I called to inquire and was told it was available, so I went with my brother to see it on Saturday, Feb 11th. Upon arrival, the dealer seemed shady and the vehicle appeared as if it had been stripped, but I overlooked the cosmetic defects because of the low mileage. I test drove the vehicle and immediately asked the son of the owner Carlos, whose name is Kenny, if the engine light was going to turn on when I left the lot. He reassured me that the car was in perfect condition.

Little did I know that on top of them selling me the vehicle empty on gas, the engine light turns on as soon as I made the deal and turned the corner to get gas. I phoned the dealer and he told me to return, but I wanted to get a second opinion from my mechanics before I turned back around. The following day, I took the car to two mechanics I know of early in the morning only to receive the bad news: it was the transmission.

They gave me the engine light code and the second mechanic, Elias, called the dealership in Miami and they told him that they would fix the problem if I drove it back to them. I drove it back to Miami on Mon Feb 12th having to take the tri-rail back home, and Carlos was clearly not happy about me having to take the vehicle to their lot again. He told me he would have it ready by the following day (today, Feb 14). He insisted it was NOT the transmission, but rather sensors outside the transmission.

Today, Feb 14th, Carlos told me the car was ready by 2pm, so I took the train back to Miami. He had cables lying inside the car that he claimed was the replaced sensors outside the transmission. He told me he was going to make the title transaction and had not done it yet, but was going to do it. He also had given me a 30-day dealer license plate, though I had already included the car in my insurance through good faith. On the way back home again with the car (specifically while entering west palm beach) the engine light came on again!

When I arrived home disappointed and disgusted, I logged online and started doing my homework on the vehicle (though a little too late). I purchased a VIN number report through a reputable website, only to discover that the odometer read 141,281 miles during the last title change in 2010.in addition, Tres Hermanos has numerous complaints about deceptive practices and mileage rollback issues. This being said, there is no doubt that I have been a victim of odometer fraud, being that the low mileage was the main reason I purchased the vehicle and was willing to pay that amount of money cash. I called the Miami police only to be told that this was a civil matter and I would need an attorney to get my money back. I used my brothers tax refund and a large portion of my daughter's scholarship money in order to pay for this vehicle that was intended for her as transportation to and from Palm Beach Atlantic University. I feel completely and utterly deceived and defrauded and only hope that you as attorney general for the state of florida can bring this issue to justice, either by calling them or sending them a letter to refund my money and they can keep their vehicle. I know what has been done to me is illegal, and it is such a shame that this dealer is deceiving many other innocent people like myself. Unfortunately, I did the investigation after I made the deal and regret ever calling them in the first place. As a resident of Florida (and a senior of 55 yrs old), I would appreciate attorney general that you take action against this establishment and catch up with the fraud that is going on in the state of florida. I literally have no words to express how I feel at this point in time. All I know is that these people need to be off the streets because they are a disgrace to society, taking people's hard earned money in deceptive practices, and I am just totally saddened. I appreciate anything and everything in your power to recover my money from these crooks! Thank you for your time and consideration to this matter.

Sincerely,
Yolanda Diaz
