1998 Ford Ranger Pickup

On 03/23, I purchased this vehicle from Pena Auto Sales, 2515 W. Van Buren Phoenix, AZ 85009 for $5,946.60 cash. When I test drove the vehicle, I noted the Check Engine light was on. When I mentioned it to the sales person, they said they would take care of it.

I decided to purchase the vehicle. I signed all of the paperwork then left to withdraw the cash from my account. When I returned, they said they were taking the vehicle over to emissions for testing. The asked me to wait. When they returned they said the vehicle did not pass, but they would need to make an adjustment and it would be fine. They handed me the keys and told me they would get the truck fixed. I left with the vehicle.

I was nervous about driving the vehicle with the check engine light on, so I had someone look at it. The codes appearing indicated that the oxygen sensors needed to be replaced.

On 03/25 I had them replaced along with other effected sensors at a cost of $269.61, I brought the vehicle over to the emissions testing station. I was asked to go into the office after having the vehicle tested. I was questioned about the vehicle because this was the 4th time it was brought in with the same problem. The woman explained the vehicle had been brought in and failed on 01/21,02/17,03/23, and today. I explained to the woman that I had just bought the vehicle and was attempting to get the vehicle fixed. She asked if I bought it from a dealer, and I said yes. She explained that it was the dealer's responsibility to get it fixed and I should not have been allowed to drive it off the lot.

I went back to Pena Auto Sales and explained that they should not have let me drive the vehicle off the lot. They didn't know what I was talking about. I showed them the ARS explaining it, and they said they were not aware that they could not let the vehicle leave the lot with a failed emissions test. They said they would fix it.

I went back to Pena's Auto Sales on 04/05 to pick up the vehicle. They stated it was ready. After arriving at Pena's, I was told it passed emissions, but the Check Engine light was still on. I asked them what the codes were, and they stated it did not matter, the vehicle passed emissions and they were done with it. I explained that if I were to drive off the lot and straight to emissions, it would again fail due to the check engine light being on and the codes it would give me. He said the emission test was good for 2 years and there should be no reason to take it back to emissions until then.

I explained that the vehicle was not fixed and that I would not take the vehicle until I am sure it has been fixed since I would then be responsible for fixing it in 2 years if it was not done now.

I was told to return the sensors that I had replaced and bring him the new ones. They would put them on the vehicle and that should fix the problem.

Since they were responsible for fixing the emissions problem, I did not exchange the sensors. I called Pena Auto Sales and told them they needed to buy their own sensors for the truck.

Pena Auto Sales called to say the truck was ready on Saturday and why didn't I come pick it up. I told him no one called me. I asked if it was all fixed and he said they did all that they were going to do with it. I asked what he meant by that and he said the vehicle had already passed emissions, but he agreed to replace the oxygen sensors to get the light to go out. I asked him to take it back to emissions before I came to get it and he said no, it had already passed emissions and they were done working on it. I told him I was going to come to pick up the truck and take it to emissions, and if it failed, they would be responsible for fixing it until it passes. He said no, they were no longer responsible because they got it to pass already, and it was now my responsibility if I took it and it failed.

I called ADEQ and spoke with Adrien Osborn regarding the complaint I submitted to them. He said he had the report and had sent out a response that day. He suggested that I contact the Arizona Attorney General's office to file a fraud complaint against Pena Auto Sales.

I believe the vehicle did pass emissions on 04/01. I believe it would FAIL if I were to take it back again. I believe Pena Auto Sales knows there is a problem with the truck.
