This problem started July 29. My daughter found Nissan Garden web-site a 2008 Nissan Altima 4dr sdn V6 for $18,625.00 so my daughter and I decided to look at the called. We call first to see if it was available and we were told it was available. We went after work at abot 5:30 and a sales person direct us to were the car was. My daughter decided she wanted the car. We sat down with the sales person and told him we will only pay what was advertised and no extra fees. He went to speak to someone and came back and said no problem. He said we will now have to speak with the finance manager.

It was about 7:00 and still we were waiting. We waiting until about 9:00 or 10:00 I was so tired and just wanted to leave. Then we were called and he stated the interest would be 8. Something and I said it needs to be lower so he gave us a 5.88 which we accepted. Again we had to wait then my daughter had to sign the papers. She sign without looking or reading she also sign her initials in a electrical box. So we went home.

The next day after work I read the contract and realized it was wrong.instead of charging us $18,625.00 They charged us $20,715.98 plus fees which came to a total of $25196.46 not including the interest rate. I returned to the dealership the same day and spoke with the sales manager and was told my daughter signed. I think they get you when your so tired. I told him the sales person was told that we would only pay what was advertise and I requested the sales person in the meeting and he stated he didn't remember. They offer a check of $500.00 I didn't know what to do so I accepted. Our payment per month was $417.05 which we paid 3 payment.

In November I received a phone call from Mr. Paul Macarelli he is field Investigator for the department Of Motor Vehicles. I was told that the car had to be surrendered to them because the car had a alarm on it. It had been repossessed and if my daughter uses the car and stop by a police officer she would be arrested. I was very upset, I contacted the dealership and I don't know who I spoke to at that time but he said to bring the car in and they would give me a loaner. The car was then sent to DMV from 11/02 - 11/05.

At this point I needed to contact a lawyer who charged me $500.00. He sent and spoke with the dealership letting them know that we surrendered the car and that we never received a title. They wanted us to pay a penalty of $9020.46 - $4047.00 which I refused. Then $4047.00 on May 17.2010 which again I refused. They came back July 7 the amount $2698.18 which I refused.

My daughter and I feel we did not do any wrong and I should not be penalize for the dishonest. I checked my daughters credit report a couple of months later and it was written as a bad debt write off so we both thought it was over. We weren't happy because her credit went from good to bad. We haven't heard anything until now we received a letter from Synergetic Communication stated they are to collect the sum of $6745.46. I called yesterday and I faxed a brief letter indicating most of the above. I spoke to a Mr Ward and he stated first we need to pay in full. Then we told him we don't have that kind of money so he mention paying in 3 payment again i said my daughter is in school and doesn't make alot of money and I don't have any money to pay. So he said if we can come up with $1000.00 now and pay $100.00 each month and when she get her income tax money she could pay the balance. He told me there would be a judement againt my daughter. I told him I would discuss this with her. I spoke with him and told him no and that I would get in contact with consumer affairs. I only want the right thing. My daughter should not be penalize and have bad credit for the dealers irrespondiablity. Please help us in this situation and let me know what are our rights. I went to a web site and I cannot believe the complaints against this dealership. I would greatly appreciate all you can do for us.
