On June 9, I entered Oxmoor Toyota dealership to look at their used cars. Upon leaving, after the young salesman learned that I could not afford to buy a new car and was not interested in leasing, he asked me to wait a few minutes and returned with a man he introduced as Keith Rice, Sales Manager.

After telling Mr. Rice several times that I was not intersted in leasing because I had never leased an auto before and knew no-thing about leasing, and many hours of his begging and persist-ence of explaining leasing through a phrase of "buy, trade, walk-a-way", he persuaded me to lease a new car by showing me a paper with the dealership's letterhead on it explaining the terms of the "buy, trade, walk-a-way" to affirm the information he had told me. Convincing me that his verbal information affirmed by the written information on the dealerhip's letterhead of leasing an auto was complete and truth.

After persuading me into the monthly payment amount that he said was the least it could be, Mr. Rice then asked for $1500.00 that the bank was requiring for the security deposit. He proceeded with the explanation of the security deposit as the same in renting a house or apartment in which the owner requires a security deposit. If, for any reason, I could not pay my monthly payment, the bank would deduct the monthly payment amount from the security deposit (telling me, after figuring on the paper he had been writing on, that the $1500.00 would "cover" me for at least 4 monthly payments). If I chose to buy or trade the car at a later time, the security deposit could be applied to that, or, if I leased the full term, the bank would refund all the security deposit due me at end of lease. He added that 60 months was the minimum a bank would lease for.

After Mr. Rice persuaded me to do this, he asked me to go into the financial manager's office, Mr. Robert Jaggers, to do all the paper work. The first form presented to me had the $1500.00 written as down payment and the monthly payment amount wrong. After pointing this out to Mr. Jaggers, he left the office for a short time to return and tell me that I was correct in the $1500.00 being for the security deposit and apologized for his misunderstanding. Having said nothing about the monthly payment amount, I brought that to his attention again. He asked what the amount was that I had agreed to, used the phone as in calling someone and hung up (I assumed he got no answer), and told me not to worry about it, "he" would just have to pay the difference.

The second form printed looked and read differently than the first and in pointing that out to him he said that Oxmoor Toyota had 2 forms they used and he must have hit the key for the second form which didn't matter because they served the same purpose (this form now reading " Amount due at leasing or delivery" in which Mr. Jaggers told me the amount typed was the total of my security deposit and first month payment to be paid that day).

After asking Mr. Jaggers to explain the entire form and being given explanations that seemed correct with him telling me many times to keep in mind that the form was written as such for the purpose of the dealership because it had to be shown as a purchase for me to go through the dealership to lease from the bank and assuring many times that my $1500.00 security deposit and my first month payment would be sent to the bank by Oxmoor Toyota. After signing the papers, Mr. Jaggers asked me to wait in the lobby and he would bring me all the papers in an envelope when he had them all in order.

While waiting in the lobby, I overheard Mr. Rice on the telephone at the receptionist desk. His words were, " I sold a new Avalon today. No man, I'm not kidding. $1500.00. I knocked her head off". I felt he was talking about me and approached him when he left the receptionist area and asked him about what I heard. He told me that he was talking about a sale he made earlier in the day, he and his buddies always "razz" each other at the end of the day, hugged me because he could see that I was getting upset, and told me that he was glad that I stopped him. The paper with the dealership's letterhead and leasing information that he had given me earlier was the last one "they" had and asked me if he could make a copy of it for me and would be right back.

Mr. Rice never returned. When I asked about it before leaving, Mr. Jaggers told me that the copy had been put with all the other papers in which he had given to the young salesman to give me because he didn't see me when he came into the lobby to give them to me.

Due to hardships of income, in November, I learned from the bank that all the verbal and written information was false to include the misrepresentations of the contract by Mr. Jaggers.

Also, my $1500.00 was never sent to the bank by Oxmoor Toyota because the bank didn't require a security deposit in any amount.

Keith Rice and Robert Jaggers knew I had no knowledge of leasing and used deceptive and fraudulent practices to lure me into a new car lease contract and took $1500.00 from me with intentional deception for its purpose. I have returned to the dealership, filed a complaint with the B.B.B. And the Kentucky Attorney General and have been offered no assistance by anyone. I consulted two attorneys that lost interest when I told them who the complaint was against.

I went into another dealership thinking that I could possibly trade the car to get out of the lease and maybe get some of my money back that I lost to this transaction, and quickly learned that a dealership is not going to offer enough to pay off the car. I did talk with the financial manager of the dealership. When he asked me why I was wanting to trade and I told him, he automatically said, " I bet I can tell you who it was-Oxmoor Toyota". He also told me that he and a friend both worked at Oxmoor Toyota at one time and that he and his friend left the dealership because of their fraudulent practices.
