Beware! Formerly Ferman Nissan of Palm Harbor. Business practices the same after10 years 4 CONTRACTS LATER! They want the new car back unwilling to give trade car back or trade-in allowance money after a month

My 18yr old niece found a car on-line that she loved at Ferman Nissan in New Port Richey. My mother and niece went there and traded a 2001 Saturn and was given a $1500.00 trade-in allowance on a 2008 Sentra. That was August 29. That was a pleasant experience for both.

Then a few days later the phone calls started at home (knowing everyone was at work), 18yr olds job, and 18yr olds cell. They didn't call the mother's cell or work to discuss that there may be a problem. After playing phone tag for a few more days they informed the mother that some papers were left unsigned if she could please come in to sign them which she agreed.

When they got there they pressured them into a second contract which was a higher monthly and interest payment. They didn't give them an opportunity at this time to think or ask questions about the new deal, or even to walk away from the deal. They left confused and uneasy about the deal pushed on them and just wanted to give the car back and get the Saturn or trade-in allowance so they could go else where.

Everything was fine until a couple of days later when again the calls started due to the same situation. This time the employees at Ferman were not as pleasant. The calls proceeded in the same manner as above. Finally someone from the supposed finance department called the mother to tell her sorry for the mix up and everything is now set to please go back to Fermans and sign yet another deal with cheaper payments than the first deal and assured the mother that this would be the last time she would have to do this. Quote ' Everything is in place and assured her this would not happen again"

After a few more days, Yes it started again. My mother informed them that she would be bringing the 2008 Sentra back to them and she in return would like the 2001 Saturn back. At that time they said they didn't have the car anymore. She asked for the $1500.00 allowance so they could use that money to go elsewhere, She was told that she was not allowed that either but they would use that money to put her in another vehicle. They have even went as far as threatening them on home phone only that they would come reposses the car if they didn't bring it back, the day after the mother agreed to bring the car back if and when they agreed to give her the Saturn or money. An attorney will be contacted shortly if this matter isn't resolved properly.

In the mist of all of this Ferman stated that the contacted the credit union where both participates bank for financing and they were denied. Through further investigating, the credit union was never contacted and yes they would've been approved for the car at 5% not the Ferman's 18%. They will not be taking the draft to Fermans and purchasing the Sentra.

Many harassing phone calls, 3 contracts, now threatting phone calls, Ferman not agreeing to replace what they took, (car or money). This is very bad business practices.

I also dealt with similar situation in 1995 when this dealership was in Palm Harbor. After a week of phone calls, wanting more money, signing a new contract or the car back. (which I did none) I contacted a lawyer friend of mine who sent them I nice letter the phone calls stopped, everything stayed as it was from the beginning and they even sent me a Thank you card for my business. It's pitiful when you need a lawyer now a days to even buy a car.
