On 7-29-09, I went to Private Collection Cars Inc, dba NY Private auto after I saw an used car on their website. Test drove the car after negotiating and agreeing on a final price with Leo Soprano, left a $500 cash down payment. I should have left deposit in a post-dated check (that I could put a stop payment if something went wrong), or a credit card (which I can dispute). But in any case, I left deposit in good faith and they told me that they were going to do the State inspection and have the car ready the next day when I could trade in my car and pay the rest of the money.
The next day (7-30) I go to pick up car and was told that 'Check Engine' light was on due to oxygen sensor and that they were going to replace it and do inspection to deliver the next day.
The next day (7-31), go to dealer and they tell me that they were given the wrong oxygen sensor and that they now have the right one and to come tomorrow.
The next day, 8-1, I was told that the car needs to be driven more to fully reset computer and get inspection. They are closed on Sunday, 8-2
On Monday, 8-4, the other salesperson Bijan F. Daryani, tells me that "I'm gonna be honest with you, the catalytic converter was replaced with an aftermarket one and not the original manufacturer and there is a mismatch and check engine light keeps coming back on and can't pass inspection. I can get it inspected but the check engine light will stay on. Just ignore it because the car drives beautifully". Of course, I said NO and told him that I can't take car until catalytic is replaced and car is officially inspected.
On 8-5, I told salesperson Bijan that I was no longer interested in car and wanted my deposit back since they don't want to replace the catalytic and the car can't pass inspection. Bijan said to come back on 8-8 to pick up refund check.
On 8-8 I go to dealer and no one is there. Called both sales people and nobody answers. Sent text message to Leo who replied that deposit is not refundable.
On 8-10 I return to dealer and Bijan tells me that "deposit is not refundable and we should split the cost of the catalytic replacement" which I immediately refused. He said that he has to check with Leo because he can't make own decisions to buy parts.
On 8-11 Bijan said that he will keep calling Leo until he answers and do conference call.
On 8-12 I received a text message from Bijan asking me to email Leo. Leo refused to try to reach an agreement on the catalytic situation and refused to return my down payment and asked me to go to small claims court.
