Ripoff deceptive company Auburn Hills

GMAC gave false and misleading statements to try to induce us to purchase a new GM product. The statements made by their GMAC representative were deceptive and fraudulent.

My husband and I were turning in a leased 2000 Chev Silverado. Our lease was not up until 5/03. GMAC sent us alot of info since 1/03 to try to persuade us to purchase another GMAC product. I talked several times with GMAC going over the lease and the roll back program which waives remaining payments on our 2000 Chev Silverado if the vehicle is turned in, as long as we purchased a new 2003 Chev or GM product.

I called a GMAC rep on 3/14/03 by the initials of RLC. I told him we are interested in buyin a 2003 Chev Trailblazer. We had our next lease payment due 3/18/03. RLC advised us to put a stop pay on the automatic check withdrawal. This would produce a 10 day grace period where we would not be subject to extra charges.

If we purchased a GM product during the 10 day grace period (prior to 3/28/03) our March payment would be waived along with the April payment. Also our security deposit would be applied to any overmileage. We purchased the 2003 Chev Trailblazer on 3/24/03,4 days before the grace period ended. Our dealership, Kocerek Chevrolet took care the 2000 Chev lease turn in and we were advised that the finance manager faxed all the paperwork to GMAC.

We were expecting a final bill from GMAC of $1,310.80. We were over our mileage and the total on the over mileage came to $1760.80 and our security deposit of $450 was to be subtracted from the overmileage. Imagine our surprise when we got a bill for $2,307.46, $1,000 over what we initially expected.

I called GMAC to tell them of their mistake and they told me I made a mistake. That I simply misunderstood. I told them I wanted to make sure of what their rep was telling me on 3/14/03 and repeated it back to him. How else would I have known about the stop pay that HE suggested. There would have not been any reason for me to stop the payment on 3/18/03 if I thought I would not be responsible for it.

I told GMAC that his statements were deceptive and fraulent. He used inducement to try to encourage us to purchase a new GM vehicle. Since this I have spoke to 3 GMAC representatives and they are telling me that we are wrong. That the 10 day period was a grace period only. If this is the case I would have not had any reason to take the grace period. For what reason???

I requested that they check to see if our conversation was recorded since companies will do that from time to time. They are going to check into, so they say, but I doubt if they will come up with anything. They do not want to take responsiblity for the statements of their employees.

I now have a bill $1,000 more than I budgeted for and if I don't pay it I am sure GMAC will turn me over to collection which will mar my credit rating. Anyone who has had this happen knows what a nightmare that can be and it takes along time to try to fix it.

I just don't know where to go from here. These large conglomerates take advantage of the small people and I feel there is nothing we can do about it. We are at their mercy. It is just unfair. If I was told the real facts we would have not been pressured to make a decision on a vehicle and would have just waited.
