Daimler Chrysler Financial Services allowed one owner of a two owner Texas titled Cadillac Escalade to request payoff without a social security number, wrong name, and without the knowledge or consent of the other registered owner's (and Primary on the Loan) knowledge or consent. On Texas Titled Vehicles both owners are required to sign teh title for transfer.

The dealership, Big Valley Autos, in Portales, New Mexico put new tires on the vehicle, stickered it for resale, and put it on their website. Upon the other registered owner's discovery of the illegal transaction, Chrysler Financial is abusive, degrading, insulting to us when we call to find out why they allowed complete criminals to trade our Escalade in for another vehicle. It had $25K paid down on it with equity.

No correct owner information was given to Chrysler concerning the vehicle. They unwittingly allowed a fraudulent activity to materialize due to their lack of paying attention to payoff request and discharge of loan information.

The dealership in New mexico, Big Valley Autos, has forged the title and we have a copy of it. When we call to inform them of pending criminal charges and request a new title issue and release of lien, they refuse to talk to or or anything because tehy say since Big Valley paid it off, they will only speak to Big Valley.

Chrysler Required both signatures to carry the loan, and hit the Primary's credit harder for failure to make payments as agreed, yet, allow illegal payoff and acquisition of the vehicle title to unauthorized people.

We are seeking an attorney who will sue Chrysler financial on the primary owner's behalf. This vehicle was a part of a much larger civil and community property situatiation in Texas. Chrysler has facilitated in the success of htis illegal transaction. If they had required a signature form both Texas Titles owners, this would not have happened.

They have allowed the 'chipping away' of community property. Texas Title laws govern this situation as their is no judgement to declare otherwise.

None-the-less Chrysler should be sensitive to the needs of one of their customers having been victimized by unauthorized parties and help in reaching a resolutiojn to this problem. The Texas Title which has been admittedly forged by the dealership is worthless now and a new one must be applied for along with a release of lien.

We are also looking for an attorney who can sue Big Valley Autos as it is dufficult to find an attorney in New Mexico who will or is able to go up against Alva Carter, owner of Big Valley Autos. Big Valley Autos also owns a dealership in Texas ans is very well aware of Texas Title laws.

The General Manager, Terry Wilcox, of the Portales Dealership has been convicted in Texas for misuse of a Fiduciary Duty and Embezzlement and is still on 10 years probation for that crime involving about $50K of customer's money.
