I bought a car and was financed through Wachovia dealer services. I made my payments on time for years, I became sick in July where I all but died. (I now receive kidney dialysis three times a week and take a load of medication). I tried to keep up with the payments but in april I fell behind on my payments. I tried to work with them trying to set up a payment arrangement or something.
I finally talked to a gentleman who told me that if I could pay at least one payment a month until October that in October they could take the past due payment and put it onto the back of the loan and bring me current. Okay, sounded like a plan. Two days later I get a phone call asking for the money again I explained to the woman on the phone that I talked to this gentleman and what agreement we had reached, and was told they had no record of this and that they never even had a record of them ever calling me huh?
This woman preceeded to tell me that there was no way I would ever be eligible for such arrangement. She would never answer my question as to why I would never be eligible. Well she said she needed the paymnet immediately and wanted me to do it over the phone, which at this point I politely refused. I now ended up in the hospital again before the payment was made. I now became farther behind, I called them to explain my situation and they had absolutely no sympathy or compassion at all, they demanded their money all at once or else I was to give the car back. Okay I can not give they car back this is my lifeline to my dialysis.
I tried to explain this to them and told them I would make payments, which I did. Well they began harrasing me somedays I got as many as 20 phone calls a day. I just stopped answering them. My daughter moved in with me because of my health and I gave wachovia permision to talk to her to see if there was anything she could do to help remedy the situation. She had made an arangement with them that I would pay one payment a month until I could get onto my feet and then I would make double payments until I got caught up. Sounded good.
Two days later we had a man show up at the front door he was there to take pictures of the car and would not leave until my daughter called a gentleman by the name of tom.in speaking with tom the only way this man who now was in my house would leave without taking the car was to make a payment over the phone... PEOPLE NEVER DO THIS!!! I had my daughter give all the bank info over the phone using my debit card, the man finally left.
The phone calls never stopped now not only are they calling my phone but now my daughters demanding money... One woman called and asked if they could do another paymnet over the phone my daughter told them that she was not authorized to give permission for that and asked if she would hold while she spoke to me, while she was speaking to me the woman hung up. We never called them back. Guess what they proceeded to take the money without permission and had they waited for permission they would have known the account was frozen.
Well now they added on insuffient bank charges. My daughter called them and asked how they could do this and they said that I was responsible because I did not call them back and tell them the account was frozen I never gave them permission to take the money in the first place. But My daughter was screamed at and argued with and treated worst than dirt by the woman she was talking to... My daughter told the woman that if she was going to talk to her that way she was going to hang up... And the woman became even more mean and told her they wanted the car and if they did not get the car immediately she was going to call the police and report the car stolen. What?
My daughter told her to go right ahead and hung up on her. This senario has been played over and over and over everytime being argued with threatened. Constantly getting phone call from supposed repo men which is just to funny at times... For example a supposed repo man called my daughter on a Sunday morning while we were at a restaraunt for breakfast and this is how the phone call went " We want the car, you need to drive it here and drop it off or tell us where to come get it we just saw you get into the car and drive away in it from an address on high street" my daughter replied excuse me?
If you seen me get into the car and drive away why did you not follow me? If you seen me get into the car then you know where it is at, you really think I am that stupid? Well guess what I am not driving the car I am out to breakfast with my family and the adress you seen the car at keep your eyes out there even though I do not live there and hung up. Then the phone calls got even worse not only are they calling me and harassing me but now my daughter also. My daughter who has nothing more than permission to talk to them when I ask her to.
My daughter has been told that if she does not turn over the car that the police will be called they have even gone as far as to tell her that they will have her arrested for interfering. Finally my daughter got ahold of a woman named Suzzette at 1-888-805-2886 ext 11441 and talked to her about the harrassing phone calls the threatining the rudeness and all and guess what they had no record of my daughter or myself ever being called hmmm. Could it be because if it had been recorded or even noted they could be in trouble for their behavior?
Well in talking with Suzette my daughter was turned over to suzettes supervisor Craig Rainey 1-888-805-2886 ext 11446 and he talked to my daughter and they came to an agreement that if I paid a payment by the 12th of the month to keep the loan at 90 days late, then we would make another paymnet of 1260.00 which is a double payment by the 20th of the month which would put us one month behind so we though and craig rainey agreed to take off the repossesion order.
He told my daughter that he really doesn't want the car back because once the car comes back not only do we loose a car but they loose the loan, because most people never make another payment. This was the agreement well on the 19 th Suzette called to confirm we were going to make the payment and guess who they called my daughter, she told her yes the payment would be there and asked her if they were still planning on dropping the reposseion order she said they were but she needed the MTCN number since we were sending it western union.
Okay we sent the payment my daughter called with the number and then when my daughter asked when the repossesion order would be dropped was told it wouldn't be, my daughter told her they had an agreement and she then denied everything, telling her that her father is now two months behind again and that he would never get this loan paid up and when could she expect the next payment. Huh?
My daughter tried to explain to her that that was not the agreement craig rainey made and was promptly told it did not matter what the agreement was this is how it is and how it was going to be. My daughter asked how they could be allowed to legally do this and suzette became like all the others mouthy rude and down right mean. She tried to explain that if I make two more double payments I will be completely caught up and she argued that I would not be, so my daughter asked her so another words if my dad makes double payments for the rest of his loan he would never get caught up that seems wrong suzette said well that is the way it is and hung up on my daughter.
My Daughter then tried to call craig rainey and left two messages on the same day for him to call her reguarding their agreement. He never called her back. Again on the same day she tried to call and now his answering machine was changed stating he would not be back in the office until the 25th of August. Hmmm wonder why he did not call her back if he was there to change answering machine message then you know he got her messages. Thats okay she will call him again on monday and she is now recording everything that is said.
My daughter told me to tell all those folks reading this who are having the same problem... Call your local new channel who have reporters who deal with consumer ripoff things most have people who do this, also call your attorney generals office and make a report also have him check out this website and see how many of the same complaints there are. Once you get this out into the public by using the local news believe me the attorney general will have no problem filling a claim... Because think of it if there is 90 of us who found this site think of all the people who have not and are dealing with the same problems we are get this out there people!
Also another little know tip for people going through this... in speaking with a very reputable lawyer... They can not report your car stolen... Your name is on the car and you know where it is at it can not be stolen, do not let them intimidate you with this, also if for some reason they do bring the police to your home you do not need to hand over the car... Unless there is a legal piece of paper called plever which is a court order they can not have the police do anything. Ask to see this order if they can not produce it ask the police officer to do his job and escort the person off your property.
Also if you want to get back at these people if you are in repossesion right now hide your car... Keep it somewhere in a garage or somewhere they can not get to it do not leave it out in the open though park it so they cannot get to it without moving another car first. And keep it there. They can not break into a building to get the car even thought they will tell you they can, and they are not allowed to move any other car to get to it either. Call a lawyer they will tell you this. And when they call you on the phone demanding the car back just laugh at them and tell them to go get the plever... My lawyer who has been in the business forever said in the years he has been a lawyer he has only ever seen one plever actually gotten because they cost thousands of dollars to get and up to two years to get.
Wachovia isn't going to do this instead they use their scare tatics and rude and sadistic behaviors. Lets stop backing down and being scared of them once they realize their antics are not going to work anymore maybe they will stop using predatory stalking behaviors and actually work with people... Just wishful thinking?
