Failure to pay off trade in and resolve suspension issue

On Saturday April, 5th I went to Little Rock Mitsubishi located at 5804 S. University Avenue Little Rock AR 72209.

I was greeted by a salesman and I explained what I was looking for, a white GTS fully loaded. The salesman went and got his manager and they came and talked to me and explained that they could not get a 2008 GTS because they were no longer being sold but that a 2009 was possible and that it had a 2.4 liter engine instead of a 2.0 but they were the same price as the 2008 GTS.

They went to check their inventory and see what they could find for me. They came back and said that there was a problem with the inventory system but once they got it working they would call me. The salesman took my number and gave me his card and I left the dealership. The salesman called me about two hours later and said that the inventory issue had not been resolved and that he would call me Monday. This was fine because I did not think that anything would get done that Saturday anyway.

The salesman called me Monday afternoon as promised and explained that they were trying to find me the car that I wanted but they were having problems finding a white GTS. At this point I told them that color didn't just as long as it was a GTS with all of the options.

The salesman continued searching. Tuesday afternoon he called and said that he still hadn't found a GTS but that they did have two 2009 ES-Sport models come in that day in Octane Blue and a Gray one. Now mind you at this point I think that the ES-Sport has the GTS suspension but not the paddles because I was told this by a previous salesman. The car did have all of the other features I was looking for and they agreed to finance a set of rims and tires for me because they could not get the factory 18 inch wheels that come with the GTS so I told him we could make a deal.

I went to the dealership on Wednesday April, 9th to pick up the car. The salesman pretty much had the paperwork ready to go when I arrived so we sat down and talked price. The car was $23,000 which I thought was kind of high but I assumed that price included the rims and tires. We finished up the paperwork and the finance manager came in and we signed the contract. The shop where I was to get my rims from was down the street so the salesman went with me to pick out my rims and tires for my new car.

It should be noted that the only saving grace to this is that The salesman has tried his hardest to make sure that everything was handled for me to the best of his ability. The rims I picked where 18x7.5 which I was told is the factory wheel size for a GTS. The wheels that came on the car were 16 inch rims.

I noticed on the drive home that the car pulled quite hard to the left when it shouldn't. I called the service center the next day and they asked me to bring the car up there. A gentleman in the service department drove the car and said that there was a bad drift to the car. He advised me to take it to a wheel shop to have the alignment looked at.

I was told that the camber of the car is set at the factory for 16 inch rims and that the 18 inch rims were causing the drift and that the factory camber bolts were not adjustable. I spoke to the manager of the dealership and he agreed to order some aftermarket camber bolts for me.

I provided him with the only website I could find that had the bolts and the price. I was told that the order was placed on April 18th and to date (05-26) I still do not have the parts and my car still pulls to the left. On Friday April, 30th I received a phone call from Toyota Financial stating that my account was past due and in danger of being reported to the credit agency.

I explained that I had traded in my car on April 9th and that the dealer now had possession of the Scion tC. I called the salesman and asked about the car being paid off. He said as far as he knew it had been paid off because he called me about a week prior to ask what finance company I had used to get the Scion tC.

Toyota has called me every day since April 30th 3 times a day in some cases wanting payment on the Scion tC. On Tuesday May 6th I went to the dealer to inquire as to why my car had not been paid off. They told me the check had been mailed on Monday, May 5th and provided me the address that the payment was sent to.

A letter was written and they provided me with a bill of sale to send to Toyota showing that I no longer had the car. Toyota has continued to call me daily seeking payment.

Now as all this goes on, I find out that the ES-Sport does not have the sport tuned suspension that the GTS has and that the ES-Sport is simply an ES with a body kit added. Overall I am not happy with the car that I purchased and to say that this whole experience has been a nightmare would be an understatement.

I called the Mitsubishi corporate headquarters to file a complaint and they assigned me to a case worker and provided a case number.

This process has been completely useless. The caseworker does not return my calls on the day I leave her a message and when she does call she give me the usual I'm sorry about this, the dealer is researching the issue. I called the corporate office to get this fixed; it is obvious that the dealer is incapable of handling this so why is the dealer left to research it?

47 days have gone by and the car I traded in has still not been paid off yet I have made two payments on my new car. The dealership has since sold the car I traded in without paying it off and the dealer had the audacity to call me and ask if I had any spare keys or the owners manual to the car because the person that bought my car was asking for it.

To recap my car pulls to the left and the parts to fix it are nowhere to be found and the car that I traded in has not been paid off. I now have a negative mark on my credit score because of this and I am in danger of the payment being 60 days delinquent. When I call the dealership and ask for The saleman or the manager they take my number but I never get a call back. If I could do this all over again I would not have dealt with Mitsubishi in any way.
