Failed to Repair My Transmission and Won't Give Back Money

Last year in December, my car began having trouble. At first I didn't know what it was, but my "O/D OFF" light kept flashing. I took it in to STS Auto in Deer Park and they told me it was just the sensors.

A couple weeks later, I got stuck on Wantagh Parkway and had to be towed to the service station in contract with Sabre Towing. The service station said that there was a leak in my transmission due to a wrong sized axle recently put in. When I took it to STS they claimed the axle was the right size, but the transmission needed to be rebuilt and we spent $2,200.

Five months later, I was back again, with transmission problems. Over the course of the year, I've taken the car back to STS for the same problem 4 times, each being resolved temporarily.in October this year, I sent it back, and they said that once again my transmission needed to be rebuilt.

They had my car for two weeks, one of which, I spent $530 on a rental car, and the second week my parents drove me back and forth to school. The manager had said if we had trouble again, he would get me the money back although now he claims he said he would "try" to get it back. When I got my car back, I took it for a drive, and was headed to Huntington when the light went back on. That was the next day.

I called back, and for two weeks I was back and forth on the phone with these guys, and now they are saying the transmission shop refuses to give me the money back because "they had the right to look at it once more". Well I had the right to get it done right the first time.

So the dilemma is, nobody wants to refund the money, I got rid of the car because we had no incentive to bring it to a place that could not get the job done, and they say that because I got rid of it, they're technically not obligated to give me back my money. The STS promise is "Your Car is Ready When Promised. Our Work is Done Right the First Time." and neither one of those promises were EVER kept.

At this point, I've written to Help Me Howard and I never received a response, I wrote to the Better Business Bureau and they said that my claim doesn't fit any of their categories. I don't want to take it to small claims court yet, because that added time, money and stress to the issue, with lawyers, receipts, files, etc. However, if this fails, I'll be left with no choice.
