Took my new truck after 2 month and won't give me back my down payment money

I purchased a 2006 Dodge Dakota on 9/6. I gave the dealership all the appropriate paperwork, filled out the application and signed the contracts. I traded in my Oldsmobile Intrigue and gave them a cash down payment.

A month later we received a phone call that all of our paperwork was missing and we needed to come back down with documentation.in the meantime they had cashed my check, I had put the truck on my insurance and assumed my trade in had been paid off. This I found out to be untrue. The new manager, Sid, informed us that the previous managers, a husband and wife couple had been fired and they took several files with them, including mine. I asked about my personal information and told them my concerns about identity theft. He dismissed my concerns. He informed me he would work on the deal personally and would call the following day with an update. He never did.

On October 29, sometime in the middle of the night they took the truck back No phone calls, no letters from the dealership, nothing. I had been in possession of the vehicle almost 2 months. I have a signed contract with the dealership giving me rightful ownership to the truck. They still had my trade in vehicle and my money. When I asked them what happened with the financing they said they were still working on it. When I asked why they took back the truck no one could give a straight answer. When I asked for my car they couldn't make that appear either. When I asked for my money they said that department was closed.

Finally Wednesday, October 31st, 3 days after they took the truck back they were able to have my trade ready for me to pick up. They didn't have my money or the personal belongings that were in the truck at the time they took it. They said they were still waiting on the bank and if we could only be a bit more patient. When I got into my car to start it, it wouldn't start. I don't know what they did to my car in the two months that they had it but they refused to do anything about it. So for 6 days I had been out a vehicle. Sid tried to give me back a portion of my down payment telling me I was now responsible for repossession fees and towing. I refused a partial payment but he wouldn't take his check back. I went next door and spoke with the finance manager at the Honda dealer. They told me only a bank can repossess a vehicle, that my signed contract made me the legal owner of the truck and that Nissan now had stolen property on their lot.

It's now November 16th, I still don't have either vehicle. I don't have my money or my personal belongings. No one at Nissan is doing anything to resolve this issue. My trade in was never paid off so I was 3 months past due (September, October & November) I went down and spoke with my credit union, told them what was going on. They informed me that Nissan contacted them on September 25 asking the payoff amount on my trade and promised a pay off by October 6. I told them they still had my car down there because it wouldn't start. My credit union has now repossessed it from the dealers lot for non payment.

My wife and I have had to take time off to go to our credit union, insurance agency, several times to the dealer, phone calls to an attorney and news station and nothing is being resolved. I now have no vehicle, a repossession on my record and am out my down payment money and am looking at spending more money to retain an attorney.
