Deceptive Business Practice

My complaint is against a car dealership. The dealership is Premier Toyota of Amherst, 47190 Cooper Foster Park RD, Amherst, OH 44001, Ph# (440) 985-6100. The owner is Bob Fisher; the sales-person I dealt with was Mike Fitzpatrick. There website is: www.premiertoyota.com.

Back in May I was in the market for a good used car, so I started surfing the internet to see if I might find a better bargain on a car. While on Cars.com, I came across this car, and it was at the price I was willing to spend, and long as there was nothing wrong with the car.

So I emailed them about this car, and the next day I got a call from Mike Fitzpatrick, I asked him several questions about the car, and that I had a few others in mind also. I asked him what was all wrong with this car, and I didnt want to waste his time, if there were major issues with this car.

He said the reason they had it marked down, was due to in the area they were located in, people were buying smaller cars, and being that it has been on there lot for a couple of months, they decided to list it on the internet before they took it to the auction. But the car is mechanically sound, and they wanted to get it off there lot.

So the other car I had on my mind I talked myself out of, to save Five-Thousand Dollars. And took this trip to there dealership, so that I could take a closer look at this car, to see if it was worth buying. I made it to there place of business, and liked what I saw and decided to take the car on a test drive.

While out on the test drive, Mike asked me how I liked the car, and I responded, fine so far. But I once more asked what are any problems with this car, he once again responded that there was nothing wrong with the car, and to me it seemed that there was nothing wrong with the car neither.

So we got back to the dealer back from what was about a Five-Mile test drive, and Mike asked me what did I think, I told him I guess Ill buy it. We went through the motion of making the sale, and I told him I didnt bring that kind of money with me, but I should have enough earnest money to hold it till Monday.

He said he needed to talk to the manager about this, so when he came back, Mike said that he can do this, but they needed me to fill out a credit application to put things in motion, telling them I will be buying this car. I told Mike I dont want to fill out this credit application, especially when I am paying cash, he promised me that they wouldnt run this application; it is for information purposes only. So I fill out the application.

So I returned by bus on that Monday and finished the sale, and I asked where the title was also, I was told they did not have it and it would be mailed to me. After I left, I drove about Ninety-Miles and air bag light came on, and the transmission started shuttering, and I made it the rest of the way home.

The next morning I woke up and took this car into the dealer here where I live, and had tests done on the car. Results were, this car needed a transmission rebuild, and is in need of air bag repair. I had to also replace the air shocks, and after closer investigation this car was involved in a collision, all these things Mike failed to tell me when I asked what was wrong with this car.
I emailed Mike and told him of the problems, and I couldnt get a response, so I emailed the owner Bob Fisher. After emailing Bob, I got a phone call from Mike, where he asked what the problem was. I told him this car, that you said nothing was wrong with. And he asked what did I want, I told him I needed to be compensated, since they failed to tell me the truth about the car.

He had the nerve to tell me, you bought the car as-is. And I told him you also told me nothing was wrong with this car also, and I took your word, being that you were a large dealership, and I didnt know of any mechanics in the area, to look over the car. And I went on to tell him that where I live, and that some of the dealers that I had called in Ohio, will take back the car, repair, or go half on repairs. If these problems were brought to there attention with-in thirty days, and the problems were there before I bought the car.

They refused to take the car back, refused to go half on repairs or fix the car period. So my next step was to file a complaint with the Better Business Bureau, where when the investigator, questioned them about the complaint. The investigator got a response back which didnt make since to him, so he wrote back to them for more information. Both Mike and Bob refused to comply with the questions the Better Business Bureau wanted answered.

So I was told by the Better Business Bureau that they had to close this case, and give them a negative report, and that I needed to file a complaint with the attorney general, and to also file a claim in small claims court to get relief. And before anyone else gets burned by this dealership, I decided to post this on consumer complaints.com.

Due to this dealership wants is your money, and when it comes to customer satisfaction, they will turn there back on you, after they have took your money. And to get your money they will lie to you, and tell you what you want to hear. And after they have gotten your money, and you need help, you are on your own due to they have gotten what they wanted, your money. So if you are in the market for a good used car, take a word of advise, do not shop at Premier Toyota of Amherst, take your business else-where, or you might be sorry, like I am.
