After three monts of run around about an unusable transmission Asap sent me, I charged them back through my credit card.
They took me to small claims court, in front of a Judge who dosn't allow testimony through the mail, or phone, you or an attorney have to show up in the courtroom. Asap hopes most out of state people won't show, and this allows Asap to get a "default judgement" against the customer they ripped off.
When my attorney showed up on court day, Asap's office worker who was there to represent them panicked and offered to drop the suit if we would. I wouldnt. They then called up an attorney who raced to the courthouse, and prompltly asked for a continuance as he didnt know anything about this case. So much for the "attorney's fees" they had added to the suit in addition to the chargeback amount.
My attorney is in discovery process with Asap now, and we go back to court early August. We may be able to help others with simular situations.
