Deception of payment terms. Unwilling do work with refunding, or returning car. Deceptive company

I would like to share with you how the purchase of a vehicle from your company Bob Penkhus Used Car Sales has affected my life.

On 7/1/02 I purchased a vehicle from your company. I was on vacation and saw a add in the "Thrifty Nickel" So I went to look at a truck. When I got to the lot, I saw the truck that was advertised. The salesman came out to greet me. He immediately took me to look at a different truck (one that was out of my price range). I told him right up front it was too much for me to afford. He insisted that I drive the truck, as he said he could get me a better deal on this one, rather than the one I was looking at. So I drove it. (BIG Mistake).

I kept telling him this was going to be too much money for me to spend. He said he could work a deal, as they needed to move the vehicle before they had to start paying taxes on it. I said lets see what you can do.

He knew that I wanted my payments no larger than $350.00, max. Lower if possible. He said lets shoot a offer at the floor manager and see where the payments would fall. So I did. The sales manager then cam out and said that he could not reduce the truck any, it was priced as low as he could go. He said he would be making zero profit on the truck and he would sell it to me and make no profit. I told him too that the truck was going to be too much money. He asked what I could pay per month. I told him no more than $350.00 he said let me see what he could do. We went back and forth on this for 30 to 45 min. He finally came out and said this is what he could do.

He got the payment down to $512.00 for 72 months, he gave me (have not received it yet) $1632 dollars that I could use during my first years worth of payments to supplement against the $512.00 payment to reduce it to the $368.00. He then told me that I would be able to refinance the truck next August for another 72 months which would then reduce my payments to keep them down to where I needed them. He also told me that I would be able to find financing in my home state for as low as 6% and maybe in to the %5 range. For 72 months. The sales people and floor manager were very high pressure sales people.

On 7/2/02 I took the truck back to see if there was anyway that I could cancel the deal, and maybe pay for the administrative cost that had been incurred, I begged the floor manager to help me out. The floor manager told me that that would be impossible, as everything is done electronically and the deal was set. I talked to a couple of car dealers in Salina, they said that if a customer came back in after even a few days that they would understand and cancel the deal.

The facts. I have looked for a lower % rate, I can not find any lower than what I have right now (%7.20) The banks have all told me that They will not refinance the truck next year for 72 months, as it will be too old to do this. I will be stuck with a $512.00 payment for 72 months, this was not part of my long term plans.

I have not gone to get my tags yet, they told me that I would have no out of pocket taxes to pay in Kansas, as they took care of this (I hope they did).

Long term effects: I have perfect credit, but I know that after a few month the truck will probably get repossessed as I will not be able to continue these payments. If I try to sell the truck, I will never get even close to what I purchased it for. I had my kids enrolled in a catholic school for the past 8 years, I have to pull them out of this school and send them to a public school (Salina has a bad public school system) So my kids will now suffer for my mistake. I have not been able to sleep or eat since the purchase of the truck I had a heart attach last year (July 17th) and this purchase has added a enormous amount of stress to my life. I feel like my entire life has been destroyed over the purchase of this vehicle.

I know the purchase was my decision, but after just one night, I tried to return the truck because I knew I had made a huge mistake. The high pressure sale of the truck, I knew, and they knew, that I could not afford. Then trying to return the truck with zero consideration for the position that I have been put, in has really ruined my life.
