Is a dishonest, deceptive, & fraudulent ripoff scam

Here is my original complaint on behalf of my friend Blanca who recently made this purchase at this car dealer "Toyota of Morristown, NJ"

First, indicated to the salesmen's (Marcus Macrea & Tony Rodriguez) at Toyota that I was solely interested in a car payment of no more than the amount I was presently paying on my vehicle of $323.00 monthly.

Secondly, that I could only make a down payment of $2000.00 and told that was no problem.

Third, of all is that I had chosen a maroon colored Sienna van not the green one given to one because the salesman insisted that this one was a better deal.

Fourth, is that the monthly payment was way beyond the payment amount I agreed to pay or could afford on my monthly auto payment installments.

Fifth, on my ride home as I left the dealership that late evening, a light indicator came on in the dash about the tire pressure in my vehicle. I had to wait to go back the next morning since the dealer was now closed.

Sixth, dealer changed contract without my verbal acknowledgement.

On the following morning when I saw my vehicle in the morning the interior of the van was scratched up on the passenger side and also on the exterior of vehicle driver's side was also scratched and addition it had glue all along tailgate and the seats. I immediately returned to the dealer on 5/22 for first time to service the vehicle and inform them of these damages, the service department worked with dash and claimed it was all right and returned the vehicle back to me the same day, but never serviced scratches or removed the glue from the tailgate. Your dealers' salesperson hurried me into his office and said that my signature was required on another form not to worry just to sign the form and everything would be all right, without informing me that this was a change of contract.

The form that I was asked to sign was another financial contract asking for an additional $1000.00 and a different price quote. Again the tire pressure indicator light in dash comes on and I return to the dealer for the second time immediately with my vehicle on the 5/24 to have it serviced and addressed the issues of the damages again not serviced. Again I am told that the vehicle is all right and asked to pick up vehicle the same day and to my shocking surprise when I arrive to pick vehicle up, I now have a bended and damaged antenna, I immediately bring this to the attention of the service department to no avail because nothing was done and I was ignored. Again I am in for service for the third time on 5/28 for the same indicator light in dash that needs to serviced and again I address the issues of damages to no avail.

Again I pick up my car as usual the same day because the service department claims it's all right and the same applies that the other damages were not repaired. It is now my fourth time in for service on 5/28 for the same indicator light now for 5 days and the other damages still not repaired. The service department now claims that they have replaced computer part for tire pressure light but not repaired other damages as usual. The vehicle performance is now sluggish since it's last visit to the service department. Enough is enough take the car back I am no longer interested in the purchase of this vehicle.

THE SOLE REMEDY FOR ANY PRODUCT DISSATISFACTION OR DEFECT, regardless of reason, is replacement with an equivalent product.*

*SELLER is responsible for consequential, punitive or other damages.*

I did not know that my contract was modified until my last visit for service on my vehicle, only when I was threatened by sales personnel that I would be put in collection for the additional $1000.00 monies due, I was under the impression that I this form was left out at the initial purchase since I was never told what I was signing. I have demonstrated the dis-satisfaction of your product and that it was not properly serviced over and over. I do not wish for a replacement or an equivalent. I, do not want to continue in contract in any way shape or form with Toyota because of the salesmen's deceptive terms and misleading practices, the harassment and all the verbal abuse dished out by Toyota's dealership each and every time I had to come in to get service on this vehicle by sales and service personnel at this facility and their fraudulent misrepresentation of the sale of this vehicle.

Please advised that I wish to cancel my contract immediately due to all of the hassles and the non-service issues never addressed by the dealership and the lack of cooperation this is a breach of contract on the part of Toyota's dealership. Please terminate contract immediately I no longer wish to do business with dealership, thank you!

Toyota presently refuses to cancel my contract after this breach of contract on their behalf
