Mine is another horror story resulting from the Capitol One buy-out of Onyx Acceptance Corp. I was unaware of a buyout until I realized I had not received my monthly statement from Onyx. I got curious and made some calls and was informed of the change.

I was also informed my truck payment was late and fees had been assessed. I mailed payment to the address they provided. The customer service representative was unprofessional and rude... Not what I was used to dealing with at Onyx. Needless to say the payment was lost, mishandled, who knows.

In the meantime, my husband and I traded in the truck financed by this so-called "finance company"... I say that because I believe them to be more extortionists than a legitimate corporation. Anyway, the major, nationally known Ford dealership in Dallas, Texas contacted this "company" on 12/14/05 and requested the payoff amount on my note. This amount was provided to them by a Capitol One representative and I purchased my new vehicle.

On December 26th, my husband received a call from Capital One advising that they were initiating the repossession process on the 2002 truck. Now, this is after they claim one payment had not been received. My husband politely informed them that the truck had been traded in and we no longer owned it. He was then asked where the vehicle was and he gave them the address of the dealership in Dallas. The rep then became irate and began to lose control.

My husband was great... He reminded her that it was not necessary to raise her voice. He also advised that any attempt by Capitol One to come anywhere near my new vehicle would result in theft and trespassing charges being filed against whoever was unlucky enough to be sent to my home.

Ms. Luce something then responded that we still owed them $1300 and Capitol One would not release the title to the 2002. She then tried to cover by saying she had never mention repossion. However, my husband did not back down on that and stated that maybe she should go back and check her recording of the conversation. Here we are on 12/31/05 and I have been called twice today and twice yesterday. It is my understanding my used 2002 truck has already been sold by the dealership.
