Last December my friends wife was driving our Durango in Warren Mi. I live in Portage MI so thats about 2 hours away from us. They were borrowing the car and she got in an accident a small one, then while she was giving the police officer some info another guy ran a red light and side swiped the Durango while it was parked. My wife called the insurance company and they said take it to Collex so thats where it was towed, I thought for sure they would total it out but the people at Collex said it was not a total loss. After them having it for nearly two months my wife called them and told them not to release it to anyone besides her. I call them and told them, I would be sending my mother down with a check to pay the deductable and I would be down later that week to pick it up.
My mother went down there signed a paper before even looking at the car, they then came out about 20 minutes later and said the radiator had a problem (mind you this was a head on collision) I called them they said there was a problem with the radiator and the man needed to fix it was out for a couple of days. Three days later they called and said it was fixed, so I once again sent my mother down there, when she got there the battery was dead they said it owuld take a couple of hours to recharge it and they would leave it out for her to pick up after they closed. She went there after hours picked up the Durango and I picked it up 4 days later. Mind you they were not suposed to release it to anyone besides my wife, and the car was in her name. ONce I got the car, I noticed play in the stearing wheel, the heat didnt work, the rear heat didnt work, the rear washer didnt work, the front foam was coming out of the hood, the paint had run down the door, the passenger door did not latch closed, the alignment was WAY off and the car vibrated when driven.
So I drive it home, and send them an e-mail the owner calls me I forgot his first name but last name was Gagliano, he said he used to own Gagliano towing. He said bring it down we will fix it, I told him I took the money out of my account for the $500.00 the bank said it was to late to stop payment, and I would not bring it down to him he had to pick it up, bringing it down to him wold involve me taking a day off work, as well as my wife so I could have a ride back. He refused to do such I told him i'll bring it down give me a loaner to go back in then, he also refused so I figured the matter was done and over with WRONG, My wife ME and My mother got a letter from a collection agency to pay the $500.00 we all told the agency off reson being 3 weeks after I had the car back the front ball joints went and the steering wheel fell off in my driveway, can you imagine if I was on the road and that happened? I would be dead. Two weeks after that the radiator went again and was leaking So I took it to a mechanic here in Portage who said they did a horrible job of fixing it and I should sure them because it cost me 1800.00 to fix all their mistakes I said I was just going to let it go I was sick of arguing with these idiots. So now they are trying to sure me my wife and my mother for $500.00 for the deductable. Morons, my mother didnt write the check you idiots, and when she signed the form she had not even seen the car yet. Anyways I faxed her the recipts so she can go file a countersuit with a statement from the mechanic showing all he fixed of their problems.
But since they sued all three of us It is going to be a big countersuit 3 people for time off work, plus gas to drive all the way down there, and the $1800 plus dollars for fixing my Durango, I am pretty sure though you are supposed to file where the defendant lives, no bother though it will hopefully cost them in the end, with all the evidence i have plus pictures this should not be a problem. Do not ever go to these people unless you want your car worse off then when it was in an accident
