On July Tanya Johnson, my bestfriend, purchased a car from Christopher L. Hogg. I am typing this as a friend and witness. Tanya put $1000 cash down on the car and began her payments in Aug. She paid $200 a month for a couple of months and then the motor blew and needed replacing.
She made her September payment of $200 and advised Chris that it needed a motor. He advised her of a mechanic and she took it their. The mechanic was slow and had not located and began to fix the problem til 2 1/2 months later and by then I had advised Tanya to take her car to my mechanic. She did and he repaired it in about 3 weeks. Tanya asked Chris to work with her on her payments and let her catch up Nov-Jan payments when she get the car fixed. He agreed. Feb came up and she paid for the car repairs on the 28th of the Month.
She also started to catch up her payments in Feb. Tanya had got the car repaired and got it out of the shop; all this time Chris has not called her or complained. (I know this because she uses my # as her contact with him) I witnessed hearing him tell her it is ok several times as long as she pays him.in March Monday 14th she took her Febuary payment and was caught up. Finally! She owed for March 15th but was not 30 days or so behind and promised it to him on the 25th of Mar. He agreed to this. On March 16th Tanya woke up and her car was gone. He had repossessed the car and told her because neglect of her payments.
She was in shock and I was too. We live 2 buildings down from open another. He agreed that she only owed for Mar-July and told her that if she payed those payments plus $150 tow fee he would give the car back. My friend can't afford a law so we went to small claims court and they allowed her to file a warrant for theft by taking against him. Today was the hearing. Chris admitted that he told her to pay $1150 for Mar-July and towing fee and he would give the car back. The judge asked her if she had it and she said no; her payments are caught up why do she have to pay if off?
When Chris repossessed her car he would not allow her to get her things out of the car. He got them out and put everything in a plastic bag and put it in his moms car trunk. He didn't give her the receipts in her the payments reciepts in the dash and other items. My friend only had one receipt in her work apron that she forgot to put in there. She lost her court case because she had no receipts and he didn't have to let her go to the car and get her stuff.
Chris returned her Feb payment to her stating that his mom took the payment and he repossessed before he got it. He told her to give his mom all the payments and he never took them! GA law is terrible and even though he admitted taking the car with no late payments Tanya still lost her car and the money put in it for the motor Over $3400.00.
