MIC Did Me Bad, Did Me Dirty Bad! Help, I Feel Violated!

23 July My wife and I had appointment with a MIC Mortgage Loan Officer, we learned later that his name as Mr. Rick Starling. The appointment was for 6:00 pm; however, he showed up much later, around 9:00 pm; so much later that my wife had already sleep by the time it was time to sign the papers, around 11:15 pm. Days after the loan had closed we started receiving phone calls from Alex Lambert, Closing Assistance Manager. Please see my reply to Mr. Lambert harassing phone calls.

Good Morning Alex,

As I stated to you before, Rick Starling (Loan Officer) at "11:00 pm" insisted that I call my bank to stop payment on the mortgage payment in question. I explained to Rick, that I had just made that payment and it was scheduled to be paid that same day. Rick had me to check my bank account to see if the payment had posted yet, it had not. Rick said, "normally, transactions doesn't take place until 12:00 midnight". Therefore, under his recommendation I called my bank, after getting through to a bank representative and giving them my access information; Rick spoke to the representative in my behalf. Rick said, "the transaction looks good, there shouldn't be a problem". Now, at that time I would have thought that Rick would have made that adjustments to the loan numbers.

Alex, if you still feel that the payoff shortage is truly my wife and I mistake and Rick Starling is not the culprit; and then, what part are you not understanding? In closing; we feel that it is not MIC hassling us for unjust funds, it is your and Rick. You guys should be saving Veterans money; not taking it, because of your mistakes.

Good Morning Alex,

After talking with US Army JAG Officers (Judge Advocate General); they advised me to send you the attachment and asked you to reconsider your position on the matter in hand. If not, they advised me to pay you only after receiving an Official Written Bill; as to something for my records.

Please see attachment worksheet; in which, Rick used to persuade me to cancel the mortgage payment to GMAC. This is his handwriting; not mine, please note the last four of my SS# (XXXX); in which, Rick used it to talk to my banker to "stop payment" the mortgage payment that was about to process, on 13 July. I also have a bank statement that indicates that this transaction took place about 1130 pm, minutes before the payment would have been process. Also, the remaining data/computations was used to motivate me to the "stop payment".

Now, I'm not understanding; why Rick didn't see this loan all the through; after enticing me to "stop my mortgage payment" at 1130 pm, why he didn't wait at least two or three business days before getting the payoff from GMAC. Again, I feel there is no way that I should be held responsible for Rick mistake. However, if your position on this matter remains the same; please send Official Bill and I will fight this battle at another time.

His reply:

Sorry Mr Robinson, I replied to the wrong email.

I have provided you with the proper documentation in regards to the payoff shortage. I understand the reason the payment was stopped, and, at the time, that was fine. However, your former lender provided us a payoff that showed this payment had already been made. We can only payoff the amount stated on the payoff; no more, no less. This is the same payoff you were provided at closing; along with a Payoff Affidavit that states if the payoff is incorrect, you are responsible for making up the difference within five days of notification by us.
