Bank of America purchased my mortgage a couple of years ago.
When I saw that they had it I was horrified because I had already closed all previous accounts with them. Prior to their holding my mortgage in their corrupt hands, I had a checking account with them.in time I found an outrageous amount of account charges on an account that was supposed to be "free." Additionally, they had a system of not crediting deposits for 24 hrs. Unless you verbally requested that the funds be deposited as cash; (of course no one would tell you this as a simple courtesy unless you complained) as a result of this I wound up with hundreds of dollars in bounced check fees when the money was actually in my account. I went to a bank officer to complain and she said. "We cannot remove those fees." Then she said contradicted herself and said: I can remove them - if you apply for a credit card with us. The card had an interest rate of 12% and I accepted it. The interest rate was raised to 29% a few months later, even though payment were made faithfully on time.
So now they have my mortgage; and there have been quite a few months this year that I have been late. But I always catch up. Meanwhile they have taken a new tak in terms of trying to forclose. Two months ago I brought the account current and they sent my check back via snail mail with no phone call. They said they did not accept incomplete payments and that they did not call customers as a courtesy. The payments were in full; and of course during the 3 weeks it took for them to re-cut the checks, put them in the mail, and for me to receive them, cha - ching, they were racking up late charges and trashing my credit. After an excessive amount of aggravating time and effort along with hefty late charges and telephone pay charges they credited my mortgage. I had to wait for the funds to clear my checking account before I could re-submit.
This month brings new meaning to scummy business practice. On April 6th I paid the mortgage in full again. I was past due one month so I made two payments. I just received a notice of intent to forclose. I called BofA and asked: "Why do I have this notice when the account is current." The clerk I spoke to said the account is two months late. I checked my local bank from which the check was drawn, and sure enough, B of A has withdrawn the money but thet are saying they have no idea where it is.
The scenarios that B of A creates to rip off the public are unconsionable and endless. There was a time when I would snail mail my mortgage payments. But no matter how early I sent them when I was on time, they were reported late. I called B of A and they said: the postmark does not matter, it depends on when it is posted. So I asked: How am I responsible for your late postings? I never got an answer on that one. I just stopped mailing.
Next I went to the interent. I paid from a different bank electronically once and the check was also returned in the mail. They made it clear that they would give me a hard time gettin my mortgage credited on time unless I had a checking account with them. This is petty extortion, only not - because on the scale of their biz this comes to millions if not billions.
If you call, you will hold for hours most of the time. Finally if someone answers they give you a number to call back on and say they will transfer you. 9 out ot 10 times I am disconneted. Now here's an anti - trust "tie in" that they practice: If you want to pay by phone and you do not have a checking account with them, the fee is $15.00 or $20.00 bucks to pay electronically. If you actually pay with a rep. The fee doubles. This is a little like blackmail or the forgoing scenario - where they trapped me with a credit card.
The B of A scenarious to rip off the public are endless. Right now they are trying very hard to force me into forclosure yet my account is current. Why? Becuase I have equity in my home. As of today they have over $2000.00 of my money according to my local bank; but B of A says they don't have it, and they have not credited my mortgage. They've got the money, the checks have cleard. They simply have not credited my account and the rep. Says he has no idea where the money is even though I have proof that they took it.
Is there a single attorney out there willing to start a class action?
