To whom it may concern, My name is Yavonne Johnson. Currently, I have a line of credit and mortgage with Bank of America. During the month of March I applied for a loan modification for my mortgage. Unfortunately, my request was denied. However, during the month of August I received a letter approving my loan for a different loan modification. The terms required me to submit several documents and send my first modified monthly payment which is $866.90 for the month of October. I was required to do this under the terms of the loan modification. All documents and cashier check had to be submitted by August 20. To ensure I was qualified for the loan modification, I sent a cashier check with all the required documents requested. During the month of October my payment was not applied. I did not want to affect my credit; therefore, I made my October payment. I called and spoke with a representative about this situation. I told her that I applied for a loan modification and I made my August payment and mailed another payment in August for October. She stated she only sees one payment. I immediately called my bank and was informed that the cashier check had cleared. I called back and spoke with another representatives. She stated that she can see two payments, but she could not move the payment, because the loan modification department had to do it. She transferred me and the phone disconnected. I called back a third time and spoke with another representative. He said he cannot do anything. At this point I asked to speak with a supervisor. After waiting 15 minutes for a supervisor, he stated that his supervisor said she will move the payment and apply it for November. I received a letter indicating that my payment was not received. Immediately, I called and spoke with another representative. I explained to the representative that I need to speak with a supervisor. I spoke with a supervisor and explained again the problem. She said I needed to call another department. I requested for her to stay on the line, because I had been transferred back and forth. She agreed to stay on the line. She explained to the gentleman at the loan modification department about my problem. He could not help me. We were transferred to another department and as always the phone was disconnected. At this point she stated that she did not want to take up anymore of my time and she will have this corrected. She stated that she will call me back once it was resolved. I gave her two weeks and she never called me. I called back and asked to speak with a supervisor located in New York in December. At this point I am furious. I asked her what I need to do to get my Lawyer involved. She said before you do this can you give me the opportunity to make this better. I told her that I have already been through this and even supervisors are not calling me back. She said she wants to ensure that my New Year starts of right with Bank of America and she will take care of the problem. She reviewed all the notes. Apparently, the previous supervisors attempted to get the issue resolve, but the request was declined. However, neither one of the supervisors called to let me know. She also reviewed the information where the loan modification requested me to mail a cashier check for October. The supervisors wrote down my contact information and said she will call me in a few days. A few days later, the supervisor called me and left me a message stating that she is still working on the problem. Two weeks passed and no call from Belinda. Two more weeks passed and no call. I called again the second week of January and asked to speak with a supervisor. He refused to get a supervisor, but he emailed the last supervisor I spoke with. He said she said that she cannot speak with me at this time and she will call me tomorrow evening. I was recommended to verify if I had to go through an arbitration process before taking this to court. I called and asked the representative. As always, he did not know. After he confirmed with someone, he was going to transfer me. I refused to be transferred and asked for the phone number. I called and spoke with another representative from the correspondence department. After explaining the situation, she said she has to transfer me to the loan modification department. I asked her does Bank of America have an Arbitration service I need to speak with if I want to dispute a problem I am having. She provided me a fax number to submit my complaint. I called today and spoke with the correspondence department. The representative could see my complaint has been received. She stated someone has been assigned to this account. She ask if I had been notified by the representative. I told her no thats why I am calling. The representative was not at work today. Therefore, the representative emailed the representative to call me.

Legally, Bank of America cannot send me a document requesting a payment for October and apply it any way they want. I was not delinquent previously or late with my payments. Now, my credit is being ruined because the bank refuses to do what they said they were going to do. It is not a hard situation to handle. You have two payments in August and one needs to be applied to another month as stated in their letter.
