Our story has been told over and over on this website by everyone
who has submitted a complaint here.
There is more going on than appears to be, it is not just bad management, poor employee work etc.
They are covering them selves very well, they have the courts, lawyers and everyone else involved so divided and seperated that the right hand doesn't know what the left hand is doing.
They have made a joke of our judicial system and have tied up the lawyers so they cannot take on our cases.
How? When they take a case to court it is an individual case and they take the original contract with them not what they are
communicating with the customers ie. Contract showes payments due $400 a month while billing is actually over $800 a month,
contract states ability to pay off early with no penalties but refuses to accept payoff even after payoff amount is given,
property is insured but they insure it and file false claims against it, Amounts are given to correct errors but are never satisfied with them and never will be. Creating escrow accounts even when escrow accounts have not been set up by the customer, never keeping employees long enough to actually prove any wrong doing on the part of Fairbanks, will not put any actual aggreements in writting and will not accept prior aggrements made before they bought the loan nor any made after said purchse.
I am sure I have not covered quite everything but these are a few examples. They go to court knowing they have the power to prove we did not honor the contract while in truth they have broken the contracts over and over again with no action taken against them.
They file in many courts go in front of many judges and each unaware of what is going on in the room next to them. I have the utmost respect for the judges and hate to see them be made fools of by this corp.
They have tied up are lawyers by hiring individual and groups to represent them in court. We cannot get lawyers because of conflict of interest they have bought them, and those involved in class action suits are only interested in torte income and not justice because if they were we would see more actual action against Fairbanks, they are not and I repeat not out for our best interest or to change anything you may get a settelment from them but beware Fairbanks will come back after you and re-claim any amount you received as a settelment.
Look at you original contract and you will see in small print that they have the right to sell your contract without your say as to who they can sell it to. This is where we lose we have no protection we have lost all with this one statement.
To stop them congress will have to have a full invistigation publicy,
Laws need to be created stopping the sale of contracts without the permission of all parties involved and a say as to it can be sold to.
We should NOT settle for anything less than the following:
1. Stop all existing and pending forclours.
2. Fairbanks Cap. Will close all existing accounts as paid in
full.
3. Take off ANY and ALL reports they have made to ALL credit-
reporting compaines, and CLEAR the credit accounts with them.
4. Repay all depts occured do to the unability to pay because
they had to be put aside in order to satisfy Fairbanks (which
never did) ie: Discover Card, Visa, Master Care, Sears,
Pennies, other mortage companies holding first and other
loans.
5. Fairbanks will return all insurance claim monies it received
under any and all insurance policies it purchsed and remove
any claimes it made to the credit reporting companies etc.
6. Fairbanks will cover all medical costs resulting from stress
created by their fradulant practices.
Congress not only has to invistigate their practices but should look into what they are doing with all the money they are extorting from us.
If any congress man wants to know my reasons for this statemen I will tell them but I will not give Fairbanks the opportunity to cover themselves on this one, and this one is blood chilling not just another insident.
All out their dealing with Fairbanks you are not alone our complaints should not be seen as individual because each one is a piece of a large picture and it's not a nice one either what I believe we are invertently subsiding through them is unthinkable.
