My husband and I bought our home from Greentree in October of 1996, we were so excited about being a first time home owner. Well, little to our surprise, what a shock it was to have a family crisis and to have to deal with Greentree/Conseco. My husband broke his foot two years ago and was out of work for almost 3 months.
I called Conseco to let them know that we would be running behind on our mortgage that was due on the 20th, I told them that it would be in there within the week past that. They told me that was no problem that I could set up a check by phone. I told them that this was fine and gave them all my account information. Well, my husbands first disability check did not come in and I was out of work for a week when our son went into the hospital the same time our mortgage was due. I called them and told them that I was not going to get a paycheck that week and to not deposit my check. I was informed, 4 days before the check was supposed to be deducted that it was too late and that they were going to deposit it anyways.
Well, I called and tried to put a hold on the check and did, Well, conseco called me a couple of weeks later and told me that we had to get money from our friends or our parents and that we had to do it by the end of the month or they would come and move the trailer themselves, the 5th day of the following month. Well, I knew then that this was not your average company. Well, from that point on it only got worse, we would send out our payment on the 18th and it would not get there until the 22nd and they would call us three or four times a day demanding that we give them a check over the phone. I told them to F* O* and hung up. I quit taking crap from them, I know they can't kick me out of my home in a few days.
So, I turned the tables on them, they would call and I would raise hell with them and hang up or I would pick up the phone and hang it up everytime they called. Well in October of we filed bankruptcy, which by the way was a relief. We included the home in the Chapter 7 and the property taxes that were a year past due. The Chapter 7 was discharged, conseco said we could continue to rent the home out as long as we kept up with the payments. So we have, for almost two years after the fact.
Our house payment is 325.44 with insurance it's 359.01, I got a phone call from Carlos at Conseco saying that my insurance is going up from 33.00 per month to 133.00 per month. I told them that was fine, that I wanted to cancel the insurance and I would add the home insurance on to my state farm policy and he told me that I owed them 900.00 for insurance that had not been paid and I told him he was a liar and told him that I wanted proof, and he said he did not have to furnish proof that I owed the money and I had to pay 100.00 plus 359.01 each month for nine months until it was paid in full, I told him he was crazy and to come get the stupid home.
I called back to Conseco a few days later and spoke to someone at the insurance department of Conseco and she told me that my insurance premium did not go up and she did not see where the extra 100.00 was coming from. Then she did a little bit of research and told me that it was from the property taxes that Conseco had to pay on the home in order to keep the county from reposessing it from Conseco. So I was pissed, I called Carlos back and asked him why my insurance went up and he said he did not know, i then asked him if was from the property tax and he said yes, he knew all along they were not going to tell me that because they know that I am not legally obligated to pay the taxes that were discharged in bankruptcy court.
I pay the 360.00 per month and got my statement from them the other day and it said I owed like 1200.00, and they are applying the 33.00 to property insurance and the 100.00 to taxes and the remainder to the home payment. How can they do that, so now it looks like I am not paying my mortgage. Which I am paying my mortgage.
They are trying to collect on something that was discharged. If someone knows how to get a lawsuit started, I am all for it. They call us at work after we have asked them several times not to, they call us and hang up and then call us and then hang up several times, they have told us to meet them at a place to fight, I mean, It's crazy.
