I signed in to your site tonight to get info on another company and was shocked to find one of the top stories was about Fairbanks Capital!
We are victims of their deceptive practices and are about to lose our home of 15 years. It started with a force-placed insurance dispute and payments being reported behind because they used mortgage funds for the insurance escrow. We entered a formal dispute with them never realizing how horrible it was going to turn out.
We are on the verge of filing Chapter 13 after this dispute continued for over a year during which time we were instructed NOT to pay our mortgage, that they would "suspend" the account until the dispute was resolved. What we did not know was that they reported us a rolling 90 days behind in our payments and have ruined our credit.
We are now going to hold off on our Chapter 13 filing while we determine if we can get included in a class action suit and get our credit restored and our mortgage back on track. Despite our attempts to resolve this "mess" we have not been successful.
I wish I'd stumbled on this back in February when we were tyring to refi and negotiate with this company. This knowledge would have saved me much time and stress and maybe we could have prevented them filing for foreclosure. I do feel better knowing I am not alone in this. I now have the info I need to fight (before this we thought something was fishy but had no proof). This company should be put out of business and every victim's home and credit restored.
So, consider this my formal complaint and I'm not going down without a fight!
