Benchmark A clear cut case of bait and switch! Benchmark took our deposit of $10,000.00 and never closed our deal. Then they threatened to keep our deposit check without a refund

Approximately two months ago my partners submitted a NO DOC softwarelease application to Teresa Billick and Jordan Pilchman from Benchmark fortheir consideration. Teresa contacted us and informed us we were approved $139,000.00and that she need two months payment totaling $10,771.49 and an executed copyof the Equipment Lease Agreement form. Asper Teresas instructions we submitted the form and the payments. Since makingthe initial payment we could not get a funding status on our file for about amonth. Finally when we heard back from Teresa we were informed that we stillwere approved however, now our deal would be a FULL DOC lease and they needed alist of documents to close out our deal. After a few more days of back and forthover the transaction we requested a refund only to find that Benchmarks policyis to hold our deposit as a fee for their brokering services. Brian Bernal acredit expert was assigned to pacify us however that didnt work. We refusedand Benchmark ignored us for about another 2 weeks resulting in us taking thetrip down to their office to get in communication about our funds and thelease. While there Teresa our rep hid out in the back of the office andredirected us to Marcus Darvin the owner. Marcus informed us that theyve beenworking hard on the file however he knew nothing about the deal. We then requestedanother refund and we again were informed that based on their policy the funds wereearned and we were left empty handed. After intense negotiation Marcus agreedto close the deal at a lower amount which we didnt want or to give us back thefunds minus their fees and commissions. My question was simply If you didnt havethe deal donewhy did you cash our check? No response. This is truly BAIT AND SWITCH and to find that severalother customers had the same experience leads me to wonder how are they evenstill in business?
