FCNB ripoff They accepted a payment arrangement and then turn me over to collections!

I recently gave a check by phone to FCNB at which time the lady I spoke with told me that I was in good shape with my account. Now I have received a letter from a collections agency they use stating that my account had been turned over to them. This is the second time I have been turned over to the collection agency (not the collection department) after I worked out a payment arrangement with FCNB. Is it not against the law to make a accepted payment arrangement and then turn people over to collections, especially twice?

I called FCNB and their automated system gave me a current balance less than the collections letter states is due and they no longer take customer service calls at FCNB. They refer you to write to them stating your problems. I have paid hundreds of dollars in late fees and charges over the years, directly related to how they account for the payments made.

I am not saying I have never paid a little late, but over limit fees charged due to late fees being charged seems illegal or at least inappropriate. I have on many occasions been told that as long as I make the payment no late fees will be charged only to find out that a late fee was charged and then an over limit fee charged totaling $70, $35 each.

Here is the real kicker. They send out a mass mailing saying all credit cards are cancelled with a few days notice. I was planning on going on a trip and using the card only to find out it was no longer good. I am very unhappy and I believe the companies credit practices violate the ethical handling of the account, the right to cure process since no notice I have ever received from FCNB stated that I would be turned over to an outside credit agency if I did not make a payment by a certain date.

My payments have never been extremely late so I am not a big credit risk. I have no late payments with anyone else. I have a $1600 per month house payment that is always on time. I have a $350 car payment that is always on time, my utilities and everything else are paid current. Why do I have soooo much problem with this company and no others?

These guys are now effecting my credit and my ability to obtain a refinance on my mortgage. I really want to sue them, is there a class action suit starting up against these rip-off artists? Is there any reason why I cannot sue based on the fact that the right to cure rule was violated? Contact me by pressing the rebuttal button. Please give me any info you can, and post this message.
