Letter to Credit Bureaus:
The HFC Mortgage account 0016459273 with Onika Popo-James and Arthur James was not legally paid in full for a lesser balance. The account was legally paid in full at the time of refinance from HFC to Americap Financial on 03/25/08. We were informed that we still owed HFC approx 2 months after the closing. We were told that we owed money due to HFC trying to attain mortgage money through our bank account in the month of February.
When all information was provided to prove that all moneys were paid either at the branch or were drafted from our account, HFC then stated that Americap financial did not pay the total Pay off amount at the time of closing. We contacted Americap Financial and they provided us with the Payoff doc from HFC and the Settlement papers and the disbursement papers to prove that all amounts were paid in full.
All of this information was forwarded to HFC who continually sent me to multiple people with different stories on who I should be talking to and what was the status of our account. We realized that this account was having a negative affect on our credit rating, when I tried to attain a new car and was unable to do so, since at that time it appeared that we had two mortgages and that I was delinquent on one of them. So we began to pay them some money and submitted $1200 although we believed that we owed nothing.
I had discussed the situation with someone and was told that we should have a lawyer look over the paper work and decide on what we should do. The lawyer upon reviewing all of the paperwork felt that we should stop paying HFC and contacted them with me (Onika Popo-James) present.information was sent to them to contact him with any correspondence and they never contacted him or me with regards to the dispute on the account.
When we tried to attain a mortgage from Cendant Mortgage Company to attain a home in Georgia, I was informed that it appears as if we have done a short sale and we were denied a new mortgage. We are moving to Atlanta Georgia in July and need a new home to move into. Waiting for 2 years to ride out a short sale that never occurred or was agreed to, is not an option.
Attached is the Payoff statement from HFC, The settlement papers from Americap Financial as well as the posted disbursements which show HFC paid in full at the time of the refinance. Also attached is the paperwork sent to HFC to have the Lawyer handle my account after a discussion on the account, which they ignored and decided to write the account off. This account has been more than a headache. We were already struggling to pay our current mortgage on time and our other bills in a timely manner while I was unemployed after graduating from Family Medicine Residency and waiting for my state license. Please investigate and have our account listed appropriately as paid in full.
This is our 2nd dispute to the Credit Bureas regarding this matter. Hopefully us sending in proof of the transaction will help us out this time!
