Denies rescission and refund requirements by law

Concerning contract, the company claims 3-day rescission applies but violates state (Texas) rescission code. The seller must provide 2 written copies of a "Notice of Cancellation", inform the customer of rescission, and provide a dated receipt at the time of the transaction to the customer. They did none of these. The invoice sent later was not dated. Each of these violates rescission code resulting in a void contract and a full refund applies.

Concerning refund, by state (Texas) code, a telemarketer must refund if the customer requests a refund within seven days of receiving service. They sell a service and send the buyer some documents to be signed, filled in, and returned before service can start. No service has been performed as I have not signed, filled in, and returned the documents to start the service. Therefore, I am entitled to a full refund.

I called the company 2 days after receiving their documents for a refund. The rep said someone would call within 24 hours. A rep called the next day. I attempted to inform and reason with the rep resulting in argumentative denial. I was told some board will review my case for a refund. The rep required a reason for refund for the board. I know of no requirement for a buyer to give a reason for refund. I was told a call within 48 hours will inform me of their decision and, if a refund was determined, I would need to return all documents. I took this as a stalling tactic and decided to immediately return all documentation.

I returned all documents to the company 3 days after receiving them. Copies of their documents are retained for legal purposes. I sent a written "Notice of Cancellation and Request for Refund" stating my position and providing related Texas State Code (Chapter 17,37, and 39) supporting my position. The statement and documentation were sent USPS Priority Mail, Certified, with Return Receipt.

I have also contested the charges with my credit card company and filed a complaint with the BBB.
