Subject: Cell Phone Scam

Dear Mr. President,

I am reporting a scam ran by your company, WireFly. Here's how it works.

1. Advertise in the Internet for a free Motorola V710 phone by offering $150 rebate (the price of the cell phone) and a 2-year contract with Verizon Wireless
2. Customers paid $150 for the phone and signed up for the Verizon Wireless phone service
3. WireFly shipped the cell phone, but did not put the UPC label on the box, which is needed for the rebate 6 months later.
4. Some customers called (like myself) and informed you that there was no UPC label on the box
5. Your customer service group then told the customer to call the rebate center
6. The rebate center told the customer to call WireFly.
7. After several run around, your customer service group told the customer to wait 6 months and submit the rebate and deal with it at that time.
8. Customers submits the rebate request 6 months later and were told that without the UPC code, there will be no rebate and the customer should have returned the phone within 30 days for a full refund when there was no UPC code on the box..
9. After numerous phone calls and e-mails, the customer gave up but cannot cancel the phone service with Verizon due to the 2-year contract.

This is a very cunning way to scam unsuspected customers who live out of state and have no way to reach WireFly for the rebate.in the meantime, WireFly enjoys the $150 profit plus whatever commission they are getting from Verizon Wireless for the 2-yr contract.

Here's my case (rebate claim# 68237607)

-I ordered the phone on 7/12/05
-I e-mailed you on 7/31/05 and informed you that there was no UPC code on the box.
-I called again on 8/4/05 and faxed you a letter (attention: Corinne), with a copy of the box showing all labels on all sides (no response from you)
-I e-mailed you again on 8/21/05 and ask for a resolution (no response from you)
-I send another letter dated 9/19/05 and ask for assistance to resolve this matter (no response from you)
-I submitted the rebate with all necessary documents on 1/22/06
-The rebate processing center rejected the request for rebate due to invalid UPC code on 3/2/06
-When I called the rebate center, they told me to call WireFly
-When I called WireFly and spoke with a supervisor, he told me I should have returned the phone within 30 days to get a full refund (it was the first time someone from WireFly to suggest returning phone)

I resent that I had to go through all these and still not getting the $150 rebate from WireFly. It is company like WireFly running scams like this that will discourage people from buying products from the Internet. I certain hope that Verizon or Motorola is not part of this scam. The fact was I did pay $150 for the phone and WireFly had not record of refunding the money. Therefore, why is the UPC so important?

If I don't hear from you within 7 days, I will send a copy of this letter with supporting documents to the State Attorney General of Maryland, BBB of Maryland and Internet transactions, Verizon Wireless and Motorola.
