When I first began my employment with my current company in March of I signed up for Direct Deposit. I had just recently gotten married and changed my name through Social Security and the CA DMV, but not yet on my bank account. When my employer went to deposit my first paycheck into my Bank of America account, it was sent back to them because my maiden name did not match the name of my payroll deposit.

Due to this circumstance, my employer told me that I would be receiving an ADP TotalPay Card... As they were transitioning to "paperless payroll", which sounds like a good idea but turned out to be a disaster.

Once I received the card, no banks could tell me what to do with it. B of A had no idea, and a co-worker of mine who started the job the same day as me went to Wells Fargo and they had no idea what to do with it, either. B of A told me that I could take money out of the ATM since it was a debit card with a PIN. Well... I had to check the balance of course, because it wouldn't let me take out enough money to pay my rent. Then, I was finally able to take out $200... How I was going to pay rent with that, I don't know! I then went home and tried to figure this card out.

It was only after researching on the ADP website that I found how to sign up to view my account online, then found out that I could transfer money from the card to my bank account.

Since I had to pay rent with this paycheck, I transferred enough money for rent from my ADP card to my B of A account immediately. Well, it took at least 3 days for that transaction to be completed... By then, rent was late. Had I received a paper check in the first place, I could have deposited it into my regular bank account and paid rent on time.

When I was looking at my account online a week later, I noticed two charges for a balance inquiry (totaling $1.00), and a $1.50 fee for taking $ from the ATM. Nowhere in the terms and conditions does it give a list of approved ATM's to take $ from so you don't get charged a fee... I figured it out the smart way, though: go buy stuff at Target and get cash back. This option worked well for me when I needed cash.

Then, I thought I had gotten all of my $ off of the card so I'd never have to use it again... WRONG! I still had a whopping $4.14 left on the card. Well, they found great ways to take my money! Apparently, I HAD $5.64 left on the card, but I was charged a $1.50 inactivity fee for the month of July. THEN, during the month of August, I used the card for $4.00 at a store and was then charged a $. 14 fee, leaving me with a $0.00 balance on my September statement.

I contacted the "Dispute" section of the website to ask where these fees are outlined:

"On my statements ending 8/1/08 and 9/1/08, there were Monthly Maintenance Fees charged for $1.50 and $0.14 respectively. Can you explain why these fees were charged and where it states that fees will be assessed in your Terms and Conditions? Thanks!

They replied:

"Thank you for your interest in the ADP Totalpay Stored Value Program.

We are unable to reverse the monthly maintenance fees on your card. All fees are fully disclosed in the terms and conditions that accompanied your card, as well as being available to view on the web site. Acceptance of this card is an agreement to all of the terms and conditions that apply.

If you have any further questions, please do not hesitate to contact us at 1-888-713-3378.

A. When did I ask them to "return" the fees??? I just wanted to know where I could find it.

B. I asked WHERE in the "Terms and Conditions" they were stated, not WHERE in the world!

I then contacted my payroll department to see if I could get another pamphlet of the terms and conditions that come with the card, as I don't know where my original copy went... They subsequently have changed to the ADP TotalPay Card that functions as a VISA card with the following website: www.mycard. Adp.com!

They appear to be the exact same card, but with different websites, and neither website can show me a fee schedule! This card is a ridiculous waste of time and employers are flat out screwing their employees if they decide this is the best method of payment for payroll!

I wish I could go back in time and do this all differently so I never would have had to deal with the mess that this brought me. I am only short about $5 or $6 in fees due to this card, but I WORKED for that money and I feel it should be returned to me.

The ADP TotalPay Card is a ripoff and I agree with another post that states there should be a class action lawsuit agains them... I'm in if any attorney is interested!
