I have been getting payday loans for some time from Cash 1. On my last loan I was not able to pay the amount in full as we are suffering a financial hardship. I stopped payment on my check and followed up with a certified letter to the company stating that my account did not have the funds available and that I would no longer have a job as of 7/31/08. I also revoked my prior authorization for electronic ach/debits from my account. I stated that I would be able to make small payments to help pay off the debt.
Further I informed them that if they were to ach/debit my account I would incur NSF fees making it harder for me to pay them.in the contract that I signed it states that IF I had given them my debit card that was on the front of my contract or if I called after signing the contract that I would be giving them authorization to use that card.in the past I have called in my debit card to them on prior loans. My current contract does not have my card info giving authorization to charge it nor did I call them to authorize a debit to my card after signing the contract.
Even with that in mind they have still charged my debit card illegallyfor $250. I had my bank also block debits from them but for some reason they were still able to charge it again. I tried talking to the manager Sharon at the location and she said that they would collect the debt as I signed the contract. I contacted the cororate office and they said that they would call the store and call me back. I received a call from an account manager that I did not get the name for due to the attitude of her phone call. I tried to explain to her that I did not give authoization for them to charge my debit card per the contract that is between me and them. She said that it did not matter and that they had it on file from before and they could do whatever they wanted with it. I said that the contract states that IF my card is on the contract OR I call with a card number after I signed the agreement that I would be giving them authorization to charge my card. However, in this instance I did not. She refused to reverse the charges and said that they would be taking $65 more dollars from my account. She also stated that I would be wasting my time and money fighting it.
I am sooo upset. I have no clue what to do but file a dispute with my bank when the charges to my account clear and send them a copy of my contract and certified letter. Stay away from these guys they are not very nice if for some reason you are not willing to pay. I could understand if I was running from the debt like some might. I do know that I owe them but at this point I am tempted not to pay one red cent!!!
