Refuse to Communicate with Deaf Person by mail on payment arrangements Waterloo, Iowa And Dallas, Texas

I was suspended from work for one week, and was not able to meet my house payment for the month of May (which was the first time this happened). I wrote a letter to GMAC Homecomings on May 19, explaining my situation. I made the following offer:

A. Skip month of May.
B. Resume payment as normal June 15 after using the grace period.
C. Having already sent in $134 for May towards the May payment, I have $400 left to catch up. Catch up schedule will be as follows: $50 in July, $100 each for August September and October, and a final $84 in November.
D. Late fees waived.

I was smart enough to send my letter by certified mail, return receipt requested as I am aware of the problems other people had with this organization. Also, last year, when I called them on the relay service because I am deaf, GMAC Homecomings put me on hold for fifty (50) minutes then disconnected me. So I decided to communicate this way.

A letter was sent on June 2 claiming they got my letter on May 27 (the return receipt shows they got it May 21). They asked me to call them by telephone, which I am not going to do because of my negative experience, so I repeated my offer, and telling them why I am communicating by mail. This response was mailed on June 5.

The next day (June 6), I got a letter from GMAC saying they want to put me on foreclosure unless I cure the behind payments in thirty days. They also want to visit any time and will bill any expenses to me. They also will refuse any payments unless its done via cashiers check or certified funds, which adds some work to me.

I already have a second job. All other creditors have been willing to work payment arrangents by mail, except this one.

I can understand their heavy handness if I were like three to five months overdue. But only one month overdue with the second month overdue of grace period yet to expire? Come on.

As we speak, I have obtained a legal referral from my prepaid legal plan and will be mailing the attroney a letter. I am planning to let my Attroney General Steve Carter know about this situation.

I am willing to give a positive follow up to this report as soon as GMAC agrees to the repayment plan or at least negoliate with me by written means such as email or regular mail as I am deaf plus the sloppy way I was treated on the phone last year (50 minutes on hold with the deaf relay and disconnected). This by the way, is a violation of Americans with Disabilities Act of 1990 which provides reasonable accomodations on basis of disability.
