Has kept me in perpetual foreclosure for 6 months without notification!

I am disabled and was awaiting my Social Security hearing for benefits when I fell behind on my loan payments at the 12.95% interest rate. I contacted Saxon and told them my situation.

In December I received a "work out" pamphlet from Saxon. Anybody else get this? Well, if you called you found out as I did that NO ONE in the customer service department had any clue as to what you were talking about.

I went ahead and followed the instructions on the pamphlet where it discussed what to do if you want to keep your home. I submitted the information to Saxon via mail. I did a follow up call and they never received the info. I printed off the information again and this time faxed it to their work out department. Another follow up call and still there were no notes of receiving the information according to customer service from the department handling the work out. I faxed the information again, but then I received a certified letter, actually four of them which I found very strange, stating that Saxon was foreclosing on my property.

I contacted Saxon again and was told by customer service that it was now noted on my account that Saxon had received my information requesting a work out arrangement, but because THEY had delayed in getting to my paperwork in a timely manner, my home was now in foreclosure and I could not bring the account current. They wouldn't accept my payments as the pamphlet had stated. As everyone else has stated, the majority of persons in Saxon's service department are missing the "kind" or "courteous" gene.in this particular phone call I was appalled that I was in this situation NOW because of Saxon's delinquency and I told this customer service rep that I wished to speak with a supervisor.in my demands to speak to anyone higher up the chain it was made clear to me that there were no supervisors that she was going to ALLOW me to speak with. Hmmm.

Numerous calls during the following weeks and FINALLY someone in customer service was kind enough (one out of how many people working there?) to hear and understand what I was saying, understand that I was the injured party here; that Saxon was the one dragging their feet into foreclosure. The service rep. Sent an email to the supervisor of "Robert", the person who was assigned my case explaining the situation. The service rep also gave me "Robert's" extension which I had not received from anyone else even though each time I had called I had asked for it.

It was the day before the foreclosure sale when I again made the call to Robert and finally got thru. That was several months ago. I was told that he was going to "suspend" my foreclosure and that I should expect some papers via Fed Ex. I would need to sign those papers and he gave me the date that those papers needed to be back to Saxon. He also said that I would have to bring my negative escrow current and submit $ amount by a certain date. At the time, my house insurance cover letter crossed in the mail with Saxon's forceplaced house coverage. The negative escrow was now incorrect with the forceplaced insurance coverage and I explained this to Robert. Robert said that would all be recalculated and my new interest rate would be back at the rate it was when I first bought my home. It was still a ridiculous rate at 9.89%, but with medical bills affecting my credit score and now with these late payments, I was unable to go anywhere else. Thank you FICO.

To date, I have received only an escrow analysis letter which showed two options regarding my NEW payment: one where I would pay the negative escrow in full (the forceplaced house insurance had been backed off, but not in total) and the second option showed the negative escrow amortized. Both options showed my P & I back at the original P&I that I first had back in 2005 and in the letter was a statement that read - "... Your new payment due May 1 will be...$". Since I had not received any other papers as Robert had said I would, I took the letter to the bank and obtained a cashiers check for the amount stated in the letter. I sent the check in plenty of time to get to Saxon by May 1st and in fact a week later I received a letter dated April 29th stating that they were returning my payment because 1.) It was a cashiers check and they wanted a certified check and 2.) It was the wrong amount because my home was in foreclosure! No other information.

I called the phone number immediately and went over EVERYTHING again with someone in customer service. She sent an email to Robert's supervisor and she told me I should hear back from someone on Monday.

No one called me back on Monday, in fact no one has ever called me back, but I did receive a letter the following Thursday - it stated that my interest rate was going up from 9.89% to 11.89%..."... And your new payment due June 1st will be $..."???

I have now taken my information to an attorney. He has tried to contact someone at Saxon to speak with them in regard to what I need to do. I'm a bit upset with my attorney because I feel Saxon SURELY is in non-compliance with several laws at this point. Surely you can not leave a person in suspended foreclosure without keeping them abreast of what is going on!

Here I am disabled and stress exacerbates my condition. I feel I have been patient long enough. I was recently awarded my Social Security disability benefits -proof of my case to Saxon as to why I fell behind, but I am so upset that I'm left in this suspended state of not knowing what is going to happen to my home, how much am I going to have to pay in back payments, what is my new payment going to be, and what will be my new ridiculous rate based on FICO, the unfair credit scoring formula! That's another rip off in itself!

PLEASE add me to the list of persons needing someone to help those who have been unfairly and surely illegally left to the mercilessness of Saxon Mortgage!

I see where someone has suggested contacting our Attorney General, which I am going to do, but is there something else I can do more immediate? PLEASE let me know.
