What Modification Agreement? Legalized Extortion

Without requesting a modification agreement or being contacted by Homecomings about any such agreement, they overnighted one to us by FedEx. Surprisingly, by just signing this agreement, getting it notarized, and sending a check for $744.58 for processing, Homecomings was agreeing to lower our interest rate and freeze it for five years.in addition to this, we didn't have to make the November or December payments which sounded wonderful considering that Christmas was quickly approaching. According to the agreement, we wouldn't have a payment due until January 1.

We agreed to the terms and returned to Homecomings a signed and notarized agreement along with that check for processing and thought we made a wise financial decision. Well, that's when the problem began.

I called to make sure they received the documents by the deadline, and they did. After a couple of weeks, I called back just to make sure that it was showing up on the account. To no surprise, it wasn't. It's February 23rd, and to this day no modifications have been made on this account.

Our account is currently thousands past due and more than four months behind. I've made many calls and gotten no resolution. I've dealt with rude, ignorant, and malicious reps and dealt with the 45 min hold times and been transferred and disconnected more times than I care to think about.

Based on my experiences with them over the last four years, I tend to agree with the class action lawsuit and have currently forwarded all of my information to the attorneys as well as filed a claim with the BBB and the attorney general's office. What's so hard to believe about it being possible that a group of greedy business professionals in an elegant high-rise suite have hired people to research the sub-prime loans currently held by Homecomings, weed out the ones with quite a bit of equity and zero chance of a refi, and maliciously target them in order to obtain the property for profit? Sounds crazy, but until you're facing foreclosure due to shady operations of your mortgage company you can't relate to it.

I no longer have good credit due to their false foreclosure report to the credit bureau, and yes, I have been late on payments before. However, my current delinquency is not caused by my not being able to pay my bills, but their failure to do their job that they agreed to do in the first place and have failed to do even after it has been brought to their attention over and over again.

The only thing we can do is pay what they say we owe or lose our home, because obviously no one will correct our account. The representatives are either completely ignorant or involved in the scam, and what a scam it is!
