December 30 Wachovia Bank gives away $180,000.00 of my mother's money to a con man. Identity Theft. Steal deception Investment scam.

On February 11 Daniel Dowling was sent in by American Family Legal Plan to set in place protection of my mother's assets in a living trust. He protected her assets alright... He eventually conned a Power of Attorney from my mother, then 81 years old.

The Power of Attorney was never requested, never presented; it was never seen. The Power of Attorney was only spoken of.

With only the mention of this Power of Attorney this slick con man played Wachovia Bank like a fine fiddle.

At Wachovia, no identification was requested or presented; no driver's license, nothing to represent who he was or that he was the real holder of the Power of Attorney for my 81 years old mother.

Not even a driver's license was requested for identification

In a very clever stealth force deception; this man manipulated Wachovia Bank personnel to wire transfer two checks totaling $180,000.00 from my mother's account into his personal brokerage account in Chicago.

The checks were made to Rosenthal Collins. We could not get an accounting or bank statements from him. Never did he speak with my mother on what or how her money was spent. Bank Statements remain at Granite Bank pertaining to the payments or expenses made by Dowling on behalf of my mother.

I obtained a copy of the checks from Wachovia. The $150,000.00 check had the receiving account number in the memo.

He so thoughtfully had made me made Payable on Death with this account; also on his brokerage account... For show only. I never saw what was in either of these accounts for more than a few seconds.

I had never had a statement in my hands... He would quickly show me and quickly put them away always for a later task of review. We would always have to do something else. Evasion always ruled.

Aggravated with his failure to cooperate; I called the bank listed on the back of the check inquiring about my mother's funds.

He never discussed this movement of funds with my mother.

I had no power whatsoever with this account. I was not a signer on this account; I was Payable on Death. You cannot be both a signer and a Payable on Death.

My mother knew I was not able to obtain an accounting... She knew I was concerned... We went to speak to an attorney together, and retained him to get the bank statements on June 26. Power of Attorney revoked in April.

My call to the bank about my mother's funds; my request netted these words; "Is this not his money? We do not accept third party funds. He does not have a license to trade on behalf of others."

As payable on Death on this account they were only able to tell me that the account was empty and had been since mid 2005. My heart sank... My mother's money was most likely gone forever.

He was red-flagged immediately as a securities fraud risk by Global Futures, Harris Bank and Rosenthal Collins, according to the agent I spoke with.

I proceeded to register this man as a securities fraud risk with NC Secretary of State, the NC Attorney General's office and contacted my local police and sheriff's department.

Money changed hands in four counties. He was scheduled for pick up by local police agents; his attorney interrupted this is what I was told.

A restraining order was placed against him for placing threats of bodily harm against me via an electronic device. He is well woven into the legal community and paid frequent visits to the NC office of the Attorney General.

I contacted the NC Attorney General's office. "If I have repercussions from your contact with the attorney general's office, you will be buried." I called this a death threat, and told him I knew the way back to the attorney general. He immediately changed his threatening tone and lowered his voice and calmly said..."I meant you will be buried in paperwork, you will never see daylight."

We had been told to contact the Charlotte FBI; this was embezzlement.

The FBI was contacted with a criminal charge of embezzlement placed against this man by my mother and me.

We supplied requested bank documents within twenty four hours; substantiating these funds actually being wired into my mother's account as mortgage loan funds.

Without question, the first special agent deemed this a matter of Homeland Security due to the trace ability factor behind destroyed in the manner of the fraud.

This con artist; this slick talking swindler has figured how to transfer large sums of money across state lines with no connection to the original account holder.

If I had not brought attention to these checks no one would ever had any way of knowing of their existence after the checks were shredded. The checks were scheduled for shredding when I requested copies of the two bank checks that were wired into to investment account. I almost missed them.

After attorney Donald Tisdale came on the scene, everything slowed to a standstill; no proper investigation into the violations of their own processes at Wachovia.

Instead both Tisdale and Dowling have attempted make this a gift from me from my mother's account... Clever idea, but impossible. I could not access it... And no one from Wachovia made contact with my mother.

With the fake Brinks heist that occurred right across from FBI headquarters in Washington DC, on January 16; I have a pattern of Wachovia violating their own security measures. Daniel Dowling just looked official and authoritative in Elkin's Wachovia Bank...

The man dressed in a Brinks uniform also looked official when he showed up for the pick up of funds from the Wachovia Bank located across from FBI headquarters. I guess clothes do make the man.

They asked where the regular driver was. He said he was the replacement and offered no form of identity; from the report none was requested,

The fake Brinks man was taken to the vault and given an amount in excess of $350,000.00.

According to the report... He signed for it and left. Wachovia Bank GAVE HIM THE MONEY WITH NO IDENTIFICATION.

This same fake Brinks criminal perpetration was also done in the same day at BB&T with over $800,000.00 being gifted to the criminals in this con game.

There have already been arrests in this matter, 6 parties I read are charged in this... I Goggled Wachovia Fake Brinks Heist to find the story.

No one is doing anything to take Daniel Dowling, if that is his name, off the streets. No one is doing anything to get my mother's $180,000.00 back.

I am ready to participate in a class action law suit as I see so many other victims of Wachovia's lax standards of security.

Wachovia should be made to take down every website they run speaking of how secure their bank is.

The egg on the face of the FBI warranted quick action to solve the fake Brinks heist. He did it right in their faces.

My mother is now 84 years old. Her flawless, never late with payments, credit is damaged.

Thanks to the acts of Daniel Dowling we have placed a mortgage against her home.
The loss of this money has forced my mother, at 84 years old, to finance her home.

My mother's home never held a mortgage. It is now warranted that we seek to refinance that loan of 2006 in order to reduce the rates of interest.

Our mortgage payments all total $5045.70 per month.

This $180,000.00 is very important to us as we intended that money for our use, not for a criminal.

As if things were not bad enough... They got worse.

New 2007 appraisals were done on all the mortgaged properties in November with the intent of refinancing at lower rates of interest.

We began with the loan (s) against my mother's home.

We were working with a lending program; as it turned out WACHOVIA was the bank that we were to work with.

The interest rate was wonderful through their World Savings program and we worked to get the loan payment reduced.

Did not happen!

Wachovia Bank sent in their own appraiser. He devalued our November appraisal on my mother's home and six acres of property.

My mother's home is charming, recently updated with new windows, new carpet, beautiful tile in the kitchen and utility area, the entry way. Her home sits on 6 acres with a rolling lawn on all sides.

This ringer of an appraiser, sent in by Wachovia reduced the appraisal value of November by $45,000.00 and denied the loan based on insufficient value of the collateral based on the loan amount sought.

We have an active loan in excess of the appraisal value of the Wachovia appraiser. Mortgage fraud... Possibly?

My ex-husband just sold 2 acres that connected to the farm for $9,750.00 per acre last fall.

This is one of the most desirable areas of North Carolina's wine country.

A major watershed project is in the plans and will include sites for beautiful residential home sites; this is only three miles from us.

There is a video on mortgage fraud that Wachovia Bank and this con man needs to view.

It is presented by the state of Georgia and pertains to the Georgia Residential Mortgage Fraud Law.

If Georgia can take mortgage fraud participants off the streets; why can North Carolina not get in step with the rest of the world and stop mortgage fraud, wire fraud, bank fraud, fiduciary violations, predatory lending, conspiracy and conspiracy to defraud, money laundering, kickbacks, over-collateralization, flipping, embezzlement, securities fraud and security violations?

These types of financial perpetrators can cost customers of Wachovia Bank their homes, property, businesses, and their security for the rest of their lives.

I am ready for interviews, movies, documentaries on crime, the comedy zone... Talk about no respect... Rodney Dangerfield did not know anything. I am ready to practice Tongue Fu to the max... I am ready. I want to sell their tactics for enough money to make these outrageous mortgage payments. I need to reflect upon the past to create my future in the present or else my mother will join the ranks of the homeless. How many shopping carts can you buy for $180,000.00?
