Underwritten By GE Money Bank Stole money out of my bak account causing several NSF fees

On 1-3-08, I mailed Care Credit a check in the amount of $175.00. However, on 1-8-08, Care Credit electronically drafted a payment in the amount of $575.00. Thus, they stold $400.00 out of my account, as well as leaving me with 12 (yes, 1 dozen) NSF fees for an additional loss of $420.00.

On 1-15-08, I called and spoke with Josh. He verified a payment of $575.00 to my account. I quickly corrected him saying the correct amount was $175.00 NOT $575.00. He placed me on hold and immediately came back on and said he, in fact, could see that the correct payment amount was to be $175.00. Then he proceeded to tell me I would have to wait approximately 14 days for a refund to be send to me. I quickly cut him off and told him that was UNACCEPTABLE! After all, the error was on the part of Care Credit not me.

I requested to be transferred to a supervisor. Krisitin was very curt and rude from the start. She told me that it would take 14-30 days for a refund, there would be no expiditing my claim, and I, not Care Credit, would be responsible for handling any and all NSF fees.

Keep in mind, Josh said it would be 14 days for a refund and I would be reimbursed NSF fees. I demanded to speak to Kristin's supervisor. She was very adamant stating Terry (her supervisor) did not take calls. When I demands to be transferred to him she told me no and hung up.

I immediately called back and told Michelle to transfer me to a supervisor. Savannah picked up and although she was nicer than Kristin, she basically told the same thing. Expiditing was not a possibility as claims are processed in the order received. She said she thought NSF fees would be reimbursed but only to a certain amount (the amount she didn't know) and that this claim would be submitted to the Payment Review department. I still don't understand that. Josh was able to see immediately that the error was made in drafting my account so why the need for payment review?

I have talked to my bank and it is being investigated. I have also sent out letters to the Texas Banking Services, Texas Attorney General, David Nissen CEO of GE Money Bank, BBB, and Care Credit Payment Review.

We'll see what happens but I am in favor of a class action law suit. I am in the process of seeing how to start one. If there are others out there who would like to file one, please let me know.
