My name is Brian and im being sued by acell aquisitions. The original debt was with Providian. The debt originated in 97 or 98.By balance then was 250.00 and to my suprise on my next months billing there was a charge for 299.00 for some type of medical insurance, which i did not authorize them to charge my account. Providian increased my balnce in order to do this withoout my knowledge. I called them to find out what was going on and was told i authorised it. I told them to show me some type of proof that i authorized it and they did not.
I called them again and we went thru this for several months. I told them i would pay what i charged and that was all. I told them to cancel my card upon reciept of what i have chraged and they said they would not close the account with an open balance. I told them it would be a cold day in - before i paid the 299.99 that i did not authorize. About a year later i recieved a letter from a collection agancy for the amount of 900.00 to 1200.00 (dont remeber which) and i disputed it. They said the same old thing i heard from Providian. I recieved a letter from an atty.in California about a class action lawsuit against Providian for doing the very thing I was disputing. I got on board and told the collection agency they should call them.
I never heard anything else about it until 2005 when i was purchasing my first home. The mortgage co. Pulled a credit report and everything was ok. 30 day later just before closing the mortgage co. Pulled another and found something that was not there 30 day prior, a debt to excell aquisitions for 3200.00. I called them to find oout what this was and i was told it was in reference to Providian. I tried to explain to them the situation and they refused to hear it. They told my wife less than a week later that they were going to garnish my check, place a lien against the home, and drive us to bankrupcy. I told them at that time knock yourself ouot (not the most mature things to say but i was angry) and they said we will see you in court, and hung up. I havent heard anything else until i recieved a civil court summons for july 3rd.
I am being sued by acell aquisitions for 4006.00 My question is this. Can they do this. Did they back date or re-age the account? I have contacted several atty.'s in my area and only 1 seems to be willing or able to handle such a case. I have recently been downsized and am presently laid off. What are my options here? What can i do if anything? Are there any answers to my problem or am i just gonna have to let them place a lien against my home. When i am sued for the amount stated can they continue to add intrest and late penalties against me? Are there any atty.'s close to me in Dickson Tn. That are good and know about these types of cases? (that wont cost me an arm and a leg) HELP!!!
