I had a membership at 21st Family Fitness Center that I cancelled in May when we moved out of the area. At the time that I cancelled this membership, I was told by an employee at the gym facility that all I had to do was "tell them when I would no longer be using the gym", and they would cancel my membership. I did this, again in May. Apparently KF Funds is their billing company.

I believe that KF Funds continued to charge me a monthly fee for a few months after this as they were debiting my checking account. I called the gym in August to inquire as to why they were still taking a monthly fee from my account, and was advised that this was an error as the membership was cancelled. No refund was ever issued to me.

I received a letter from KF Funds approximately January demanding payment for a membership, and I called the gym for the third time and again confirmed that my membership had been cancelled in May. I have now received a letter from KF Funds dated March 16, demanding payment of $274.75 and threatening collection and adverse affects on my credit. I contacted the gym for the fourth time yesterday and was advised first that my membership was cancelled, and then that I could only cancel my membership through KF Funds.

This statement was completely contradictory, and was the first time I was told this. The woman at the gym then refused to speak to me any further. My wife called KF Funds today to discuss the situation and was told in a most condescending tone by the representative that "It is clear in your contract that you must cancel your membership in writing with KF Funds. So you owe the money".

When my wife explained the numerous times we had spoken with the gym and had been advised that the membership was successfully cancelled, the representative simply repeated, "that's fine, you still owe the money". I have not lived in Windham since May of and certainly have not used the gym.

I was told by the gym multiple times that my membership was cancelled, and now KF Funds is demanding money that I do not owe. The fact that no one at the gym or at KF Funds gives me the same answer when I call really calls into question their professionalism and integrity.

I filed a BBB Complaint and Walter DaSilva of KF Funds' answer to them was simply, "the "member" signed a contract and we will not waive the debt, it is now with a collection agency".

Walter DaSilva and everyone else at KF Funds is completely lacking in customer service skills, business ethics and integrity, and honesty. This company is nothing but a bunch of crooks looking for loopholes to get extra money out of people, and they have not heard the last of this. Word of mouth is powerful.
