Ipoff Failure to Honor Refund Request

PrePaid Legal Services (PPL) has failed to honor my refund request of $135.80.

I became a member of PPL on 12/12, pursuant to my membership agreement, I could cancel my membership and receive a full refund. On January 9, I contacted PPL (via telephone) and informed PPL that I was cancelling my membership immediately. PPL told me that I needed to confirm my cancellation in writing. Accordingly, on January 10, I wrote to PPL and put my cancellation request in writing.

PPL continued to charge me a monthly membership fee for the months of March, April, May and June, for a total of $135.80. Unfortunately, (since my wife does the bills) I was not aware of these charges on my checking account until July.

In July, I contacted PPL again and informed them that I had cancelled my membership in January and that I was overcharged. I told them I wanted a full refund of the $135.80. PPL stated that they had not recevied my written request in January and that was why they kept charging my checking account.

I told PPL that I sent my written request on January 10, and that I did not know why they did not receive it; I suggested three possible reasons: (1) the request was lost in the mail; (2) the request was lost in PPL's mail room or (3) the request was improperly processed by PPL. PPL still did not refund my money. I then contacted the Better Business Bureau (BBB) and lodged a complaint with them.

PPL responded to my BBB complaint and they acknowledged that they had received my January 9 cancellation request, but, they stated that they never received my written request of January 10. PPL informed the BBB that if I could "provide documentat that [Mr. Badanes] sent and our offices received of an [his January] cancellation, we will review the information and another determination will be made as to his eligibility for an... Refund."

It is unreasonable for PPL to expect me to provide documentation of PPL's office receipt of my written letter — I can not provide documentation of something that is entirely out of my control. The fact remains that (1) PPL agrees that I cancelled my membership on January 9; and (2) I sent written confirmation of that cancellation on January 10.

It is unfortunate that PPL will not honor my request for a refund, especially considering that I am only asking for $135.80 and PPL has probably spent more time and money in denying my request that in honoring my refund request.
