I have a checking account with Wachovia Bank, the branch I used is in Arlington, Texas. My husband was on the account as well. I am on Social Security Disability, so I only have a certain amount to live on each month. My husband was not working at the time. He and one of his con-friends, stole some checks from someone. Went to Wachovia at the Drive Thru at that, without the funds in the account of my to cover the check, during some time Wachovia cashed a total of 4 checks totalling about $1399.87.
I was unaware that any transactions had even taken place. I have bank alert email sent every morning to my email. I almost had a Heart Attack when on March 30, I opened my email to find I had an overdraft of $1448.31. That is totally bank fees and such.
I called the bank, was told my account was in investigation. I was also told that my husband was the one who cashed the checks and that they were made out to him. The other party checks, did not have any information about the person. NO, phone number, address or anything except a Initial and last name. I was sick.
I then confronted my husband and he admitted to the whole thing, he even admitted that he knew the checks were stolen. I then called the bank and told them, I wanted legal charges pressed against them. I called the local authorities and no one would help me. My Social Security check is direct deposited, I could not stop the deposit because it was to late.
Wachovia now wants me to sign and agreement with them to repay the remaining balance. They first wanted me to pay the total back in installments and they would release my check. Needless, to say, my husband is now about to be my ex for this offense and varies others that he has done.
I dont think its fair, since Wachovia took it upon themselves to cash these 4 checks without making him deposit and wait for the to clear before making the money available. I realize also, that being married to someone makes one kind of responsible. But, the checks were made out to him, he endorsed them, he got the money and I had no knowledge of the event.
So, now, I am separated from my husband, broke and have no way to get my medicines filled, can not get a place to live. I have nothing. I still think Wachovia, should be responsible for the way they conduct business. I appreciate the way the say, the account was valuable to them and that there had never been any reason to question a check being cashed, but with todays identity theft and other security issues they should be more cautious before just cashing a check.
Please, take heed. Request that no checks be cashed on using your account unless funds are in your account or asked that all checks be deposited and wait for them to clear before funds made available.
I just find it strange, that Wachovia wanted my Tax Refund check deposited and made me wait 5 days for the funds to be made available, but would cash checks outright, without and information about the other party.
