I was served foreclosure papers in June. I had been out of work for 6 months and missed 4 payments. Finally set up a repayment plan with 2300 due on Sept 1. Scheduled a bank draft for 2300.00. All month I contacted ASC as to why the money was still in my account. They told me not to worry, they would contact me if there was a problem. On Oct 2, called to set up October's payment and was told I had broke the payment agreement. They had transposed 2 digits in my bank account, but they said it was my fault. They set me up another payment plan with 3000.00 due on Nov 10 and 715.00 per month for the next 6 months. I paid 3000.00 and 715.00 per month for Dec, Jan, Feb and March, all due the 10th of each month. I sent every payment Western union Quick Collect. On March 23, I received a letter saying my payment had been returned to me via Western Union, because it was not for the amount due on the account. I promptly called them and they stated that I had broke the payment agreement and my home had been returned to the attorney's for foreclosure. I told them I had sent the payment on Mar 9 and according to
Western Union, ASC accepted the payment on Mar 10 My Due Date. Many many phone calls, sometimes resulting in disconnection or hang up from ASC, I finally had Western Union contact ASC. The accounting dept told Western Union the payment was accepted on the 10th of Mar and that they had been instructed on Mar 20 to return the payment to me. They would not give a reason. I am currently waiting on confirmation in writing from Western Union of the acceptance date at ASC. As of Mar 28, Western Union has not received my payment back, they said ASC still has it. Also ASC wants to set up another payment plan requiring 4500.00 down and 1000.00 per month for the next 6 months. I am so fed up with ASC, I want to tell them to just take my house, I don't have any mnore money to fight to keep it. What are my chances of beating these liars, crooks and misfits? Who can I show the Western Union Receipt? I have proof they accepted my payment on the 10th but they say they didn't. The ball is always in their court and they never seem to pass it. They have control. Help, I don't want to lose my house!
