I have had trouble getting $1700 of fraudulent transactions taken off my Capital One credit card. My credit cards were stolen out of my locker at a fitness center in August. The thief did not take my purse and the locker did not appear broken into so I did not know anything happened until I received letters in the mail from the credit card companies alerting me of possible fraudulent activity.
I immediately called and reported them stolen. I filed a police report and sent back the affidavits. The thief ended up charging a total of $3,000 on 2 credit cards (Capital One and another card) I have 4 credit cards but they only took 2 to keep me from noticing.
Capital One won't take the charges off because the day after my card was stolen I called the 800 automated customer number for my balance to find out when my bill was due (My mail was being sent to another address so sometimes I called for my balance on my cards to make sure they're not late) I had at that time about $1100 something left on my Capital One balance that I was paying off. At the time I made that call, the thieves had not yet accumalated a large sum of money on that card so I did not notice anything unusual in the balance. I did not have my card when I called; I got the number from my file and thought the card was around my apartment somewhere. I was paying the card off and had not used it in a long time.
I have tried to resolve this with Capital One but they put me on hold for hours with no results. Capital One claims that I made the 1-800 call 20 minutes prior to a purchase which is just bad luck. The thief used that card from the night of August 3 until August 8. I made that 1 800 phone call on the afternoon of the 4th.
I've tried gettng help from the police to find out who did this, but they will not do anything. YES, I know, I KNOW I was very dumb and careless and this is embarrassing, but I did not authorize those charges or have knowlege of them. I have been upset over this for months. I don't know if I should file a small claims suit against Capital One to try get the fraudulent charges taken off, or if I should let it go since they will use that call against me.
