I was behind my October and November car payment, due to uncontrolable circumstances. We contacted Wells Fargo to set up a re-payment plan to get me caught back up to date. We were told that our best option would be to put in a request to have those two months defered and added on to the end of our loan.
In order to do so we would need to send them $202.00 to cover late fees for those two months. We were told not to make Decembers payment (which was due on the 4th) until the deferal was through being processed.
On November 27th I had the money automatically taken out of my checkiing account through EFT. I was told it takes a total of 5 days to do the whole deferment application, and that I would be contacted as soon as it was processed.By December 7th we still had not heard from them, at this point I was now late Decembers payment too.
I called them that day and was told that the money they took out of my checking account was not applied to the late fees as it was supposed to be so they could not process the deferal until they applied to the late fees. I asked if I could at least make Decembers payment so I wouldn't get further behind and was told not until the deferal was through being processed.
Still as of December 31st I still did not hear from Wells Fargo Finacial so I called them again and was told the money was still trying to get re-applied. (35 DAYS LATER!!!) I asked when they noticed the money was not applied correctly they told me November 28th the day after they took it out of my checking account. I asked what the hold up was and no one could tell me. I asked to speak to every supervisior at the bank and got voice mail after voice mail, I left over a dozen messages and no one would call me back.
I asked the woman again on December 31st if I could at least make Decembers payment and once again was told no. I informed her that I would now be three months behind on my car payments and was in fear of losing my car. She told me there was a hold on my account until the deferal was through and that my vehicle wouold not be repossesed.
January 10th they came and took my car. I called Wells Fargo all day, no one would get on the phone with me except customer services representatives would could just read what it said in my account. They said they did not know what happened with the money I paid in late fees. They I was told the deferal didn't go through because they were waiting for my husbands employment verification, which no one asked the two times I called to check on deferment status. Every time I call I get a different story and I have recorded every phone conversation since my car has been repossesed. Still no answers as to why my car was taken. Still no supervisiors will return my calls.
I have spent over $10,000 for my dream car a 2003 Toyota Celica and still have $20,000 left on my loan to pay. Now I have no car, I lost money at work I deliver pizzas, now I can't, There are laws prohibiting unfair and deceptive trade practices in consumer transactions. I gave them the money with thebelieve they were trying to help me keep my car when in reality they helped me loose it.
Can anyone help me?
