Predatory lenders no help during financial hardship when they say they will. Homecomings will foreclose on your house and sell it at auction! Liars!

A little while ago, I bought a house for myself and my wife. A few months after we moved in, I started having trouble making the payments on time, and immediately attempted to contact Homecomings to see if I could get the payments reduced.

To no avail, every time that I called Homecomings, I was either put on hold indefinitely, given the "run-around, " there was no answer, or I got the answering system. This continued for months, with me actually speaking to someone once or twice via the contact attempts. No one was willing to help me. Homecomings has merely and intentionally strung me along for this MISERABLE ride.

My wife and I are completely stressed out beyond our limits. I know that the toll all of this has taken on my wife has been devastating beyond words. Her health is deterriorating right before my eyes. This level of stress is entirely too much for her to handle, both physically and mentally.

Unfortunately - due to circumstances beyond my control - I lost my job twice in the same year. The first time that I lost my job, I immediately contacted Homecomings to see if they could help me by reducing my monthly payments.

I repeated the same process upon the time of the second job loss. I was ushered the same song and dance as far as income was concerned. Apparently, it was MUCH easier to secure the mortgage loan, than it is to keep it once you have it. Homecomings has made it VIRTUALLY IMPOSSIBLE to succeed at paying off the mortgage loan in times of HARDSHIP!!!

All Homecomings Financial wants is ONE thing - MONEY. They don't care how they get it. They have LIED, MANIPULATED, and DECEIVED us - we TRUSTED them to keep their word in helping us keep our home. Yet, all-the-while, they've been SCHEMING behind our backs to take our loving home right out from underneath us!

I needed to apply for HARDSHIP. They did NOT accommodate.

Even though I was receiving unemployment, I was willing to pay as much as I could each month. Homecomings would NOT help me. Their Customer Service Representatives were DOWNRIGHT RUDE and NASTY when I questioned them about the varying/conflicting amounts that were given me by their own people.

The representatives at Homecomings treated me like I was nothing, and talked to my wife and I like garbage. How DARE they?!

Regardless, I begged them repeatedly to adjust my loan so that I could continue making payments - even though I was receiving unemployment compensation.

Homecomings told me they couldn't help me unless I had a job, and could provide two pay stubs to prove that I had a steady source of income. I find that interesting, because OBVIOUSLY, nothing is ever promised. If it were, I would not have lost my job of FIVE YEARS exactly SIX months after I bought my house.

Given that I had at least six months of unemployment assistance coming to me, I tried to tell them that it was still INCOME/MONEY. I just needed Homecomings to work WITH me - not AGAINST me - so that my disabled wife and I could stay in our home.

Regardless, Homecomings received their money. I was told that my arrearage was paid, and that my loan had been reinstated. Yet, they still placed my house into FORECLOSURE - without my knowledge!

I EVEN have the court documents to prove it (I just received them in the mail). It CLEARLY states that the Defendants have tendered to Plaintiff [Homecomings] the amount which would have been due under the terms of the Note and Mortgage being foreclosed herein had there been no acceleration of maturity, together with costs and resonable attorneys' fees incurred by Plaintiff to date. Said amount has been accepted by Plaintiff to reinstate the loan in full satisfaction of all other matters in controversy.

In PLAIN english, doesn't that mean that we PAID Homecomings their money, which was ACCEPTED by Homecomings? In return, Homecomings agreed to REINSTATE the mortgage loan? Isn' that what was SUPPOSED to happen? Don't the courts have the FINAL say so?

Yet, Homecomings (A GMAC Company) and their attorneys Kropik, Papuga, & Shaw are just NOW entering a MOTION TO DISMISS CAUSE of ACTION. This should have NEVER gone into court in the FIRST PLACE. Homecomings merely threw our house into FORECLOSURE without JUST CAUSE, and LEFT it there to be SOLD AT AUCTION!!! When, in fact, my mortgage was PAID!!!

This is EXACTLY why I have NOT been able to re-finance my mortgage with ANOTHER lender so that I could make payments that I could afford while I still had a job. Homecomings (A GMAC Company) practices UN-ASHAMEDLY UNETHICAL TACTICS (and DOWNRIGHT IMMORAL) in TARGETED, LOW-INCOME, HIGH-RISK AREAS!!! They know that the people that they do business with in these particular areas/income brackets do NOT have the FINANCIAL CAPACITY to invoke LEGAL ACTION against them.

My unemployment benefits exhausted a couple of months ago. There has been NO MONEY, whatsoever.

After my wife and I received subpoenas in the mail (why she received one when she is disabled unable to work, and NOT even on the loan evades my comprehension). A few days later, I was FINALLY able to speak to a real person at Homecomings. They suggested that I apply for HARDSHIP - which is EXACTLY what I did.

What is the purpose of applying for HARDSHIP with Homecomings, if they're going to SLAM my HOUSE into FORECLOSURE and SELL it at AUCTION anyway???

Naturally, a few weeks later, I found a new job. Now that I am working again, I have been trying adamantly - once again - to get Homecomings Financial to work with me on moving the arrearage to the back of the loan, and reduce the mortgage payments by removing the unnecessary factors (such as PMI, Homeowners Insurance, etc.) from the monthly payments. Unfortunately, I still haven't been able to get ahold of anyone to discuss this matter and make arrangements.

Redundantly, I've called and called - STILL cannot get ahold of the person whom is supposed to be handling my case. The closer it gets to the court dates, the more scarce Homecomings makes itself - if that's even possible (given that I hardly ever get anyone on the phone, and they rarely ever return my phone calls when I leave a message).

To make matters WORSE, Homecomings is going to turn right back around two weeks later, and put our home right back into FORECLOSURE so they can SELL IT AT AUCTION!!! This is RIDICULOUS!!!

It is HIGHLY PROBABLE that we are going to lose our house and everything we own to these VICIOUS PREDATORY LENDERS and wind up living/dying (my wife CANNOT survive due to her health/physical condition) on the streets. We are financially poor and cannot afford to hire an attorney to represent us. So, I've made it my personal agenda to supply this information to anyone who is in need or interested in helping/taking action against Homecomings Financial (A GMAC Company).

It is CLEARLY time for EVERYONE to take a stand against HOMECOMINGS FINANCIAL (A GMAC Company). IMMEDIATELY, file a COMPLAINT with the ILLINOIS ATTORNEY GENERAL LISA MADIGAN at www.IllinoisAttorneyGeneral. Gov. The phone number is 1-800-243-0618 (Springfield, IL) and 1-800-386-5438 (Chicago, IL). For those of you who do not reside in the state of Illinois, IMMEDIATELY contact your state's Attorney General to file a complaint.

There are SPECIFIC laws that have recently been passed to protect consumers from PREDATORY LENDERS in the state of Illinois. You may find this information at:

Please IMMEDIATELY contact the FEDERAL TRADE COMMISSION to FILE a COMPLAINT at (877) 382-4357, or go to their website http://www.ftc. Gov/ftc/consumer.htm. Click on FILE A COMPLAINT, and it should take you directly to the appropriate form.

You may also IMMEDIATELY contact the CONSUMER FRAUD BUREAU at (800) 243-0607, or (618) 529-6400, and ask for the phone number to the Mortgage Regulator within your state.

If you need an attorney and cannot afford one, contact you local legal aid organizations for help. At the very least, they may be able to refer you to someone who can help you.

So, file the complaints!!! Use the resources available to you in your state, as well as in our Federal government, and LET'S HANG THEM OUT to DRY!!! Together - Let's AIM HIGH for that CLASS-ACTION LAWSUIT!!!
