I am not a customer of Roadloans/Triad, but I bought a car from my sister-in-law who financed it through them. I had my bank finance the car last april (04) and my bank gave her a check for her asking amount, which was more than she owed on the car. She deposited the check and wrote Roadloans a personal check for the payoff amount that she was told over the phone. It took months for my bank to get the pink slip for the car from Roadloans, but they finally did and my husband and I are listed as the registered owners. My husband recently has been getting calls on his cell phone that say "restricted" for the caller ID, so one morning he decided to answer the call and see who it was.

It was Triad Financial saying they wanted the car back. Well, I called them to see what was going on because I have had the car for almost a year and it is financed through my bank, so I was wondering how if my bank has the pink slip, Triad can repossess the car. Well, I ended up talking to a really rude lady, who pretty much said that my sister-in-law purposely wrote them a bad check so they want the car back. I asked her how they can take the car back when my bank has the pink slip and it no longer belongs to my sister-in-law and they said they were recalling the title.

I told her it all sounded a little suspicious to me and she then proceeded to raise her voice and tell me that noboby was trying to screw me there, that my sister-in-law screwed me by writing a "hot" check (in her words) and that my sister-in-law knew what she did (she kept saying that over and over). She pretty much said my sister-in-law was a criminal and that she purposely wrote a bad check for the car. After more arguing with her she asked me if I had a lawyer and I told her I didn't know I neeeded one, so now I am hoping they don't take a car from me that I have been paying on for almost a year to my finance company. I called my sister-in-law and told her the above info and she called them and she said she never wrote a bad check and faxed them the returned check from her bank proving it went through, but it does look like she may still owe them money though. I still don't see why they are coming after a car that has not been theirs for almost a year and they want to take it from me because my sister-in-law supposedly still owes them some money. Is this legal?
