Approved inflated and falsified appraisal now owe more on home then it's worth loan adjusted got behind loosing home

Back in 2002 I refinance my home do to divorce. About a year ago my son was injured and couldn't work and had no medical insurance. I tried to refinance in April but had 2 max'd out credits on my report that were not mine. At that time Beneficial contacted me and used the 2002 appraisal for a 2nd mortgage, I paid off many bills and started a remodel. Once I got the credit cards off my report my score went from 543 to 620 so I tried to refinance to combine both loans and then found out I owed more on my home than it was worth. I got a copy of the appraisal from First Franklin Mortgage and discovered that it was falsified and inflated by around 20,000.

Shortly there after I got ill and was off work and got behind in my mortgages, I tried to keep up with everything once I got back to work full time but in October had to file a Chapter 13 to stop an approaching foreclosure. Both mortgage companies failed to verify the validity of the appraisal and now my credit is damaged. If the appraisal had been accurate I would have been able to refinance when I needed to before I got ill, I may have gotten ill do to all of the stress I was under. During my initial meeting with my bankruptcy lawyer I informed him about the falsified inflated appraisal he at that time told me specifically not to say anything to the bankruptcy court and was very adamant about it I did not question it till recently. I did tell him after the bankruptcy hearing in October that I was possibly going on sub-contract at work it would allow me a little more money but there could be a chance that I my not get full pay for several weeks and this may cause a problem with the mortgage company he didn't seem to care.

I had also discussed this with the bankruptcy department at National City Bank and was told that I could resume my payments at the end of February and everything would be ok. Behind my back Adam at National City Bank who I had a payment arrangement with turned the account over to they lawyers to have it removed from the bankruptcy I found out about it from my lawyers office. I had been searching for someone at National City Bank that had the authority to fix my loan do to their negligence and got the email address of the President and CEO Leo Knight of National City Bank he referred me to MaryJoe at First Franklin Mortgage to get information to do a loan modification.

I sent another email to him explaining that their lawyers petitioned the court to have the case dismissed from bankruptcy I asked him to cancel this action and was referred to Gary Stockey of First Franklin Mortgage he had me send my financial information to MaryJoe and then MaryJoe sent it to him. Mr. Stockey contacted me stating that I did not qualify for a loan modification. I told him even though your company caused this situation you are not going to take responsibility. He then asked me to send him the proof of the falsified and inflated appraisal which I sent to him on 4/3/06. On 4/3/06 I received a confirmation from the bankruptcy court granting the dismissal from bankruptcy so now National City Bank can foreclosed. I am a victim of a consumer fraud and no one will help stop these crooks from taking my home.
