We refinanced with Ameriquest a few years back. We had bad credit from identity theft, plus I was self employed. I cannot begin to tell you about this horrible nightmare with these people. We first were told that we would have payment alot lower than we actually got. We never received money at the closing, the lien they were to pay off never got paid off we had to repay the lien.
They ballooned our appraisal and never gave us a copy. They had us sign paperwork with their attorney at seven pm at night... And as we were signing the manager came flying into the closing and said the paperwork had a mistake on it and they switched paperwork. Then when we continually called them for the money they said oh your closing ate all of the money. And surprise they did not pay off the lien they were supost to pay. Well a few months went by and I received a letter from them that we were behind on our payments. I said there is no way we were behind... But they sent us a break down and said we missed a payment. We said absolutely not. They stated that we were so we checked with our bank and sure enough it had been paid with electronic check by phone. Well they were quiet for the next few months then we received another letter we were going to have to catch up our payment or they would start foreclosure proceedures.
I always paid by electronic phone payment because they had stated checks were bouncing when they had in fact cleared. Well We received a call from our bank that they stopped a payment to Ameriquest because they were trying to take out a substantial amount and the bank thought it was erronous, so they called me. Well things got worse... They continually kept trying to pull out thousands upon thousands of dollars. So the bank kept stopping them. Then calling me... I called ameriquest and was put on hold then when I finally got a live person they stated that it was a computer glitch and we would be alright and to give her another payment and it would not show late on the credit report.
Well I gave her a payment over the phone and quess what they did it again this time they tried to take twenty five thousand dollars for a one thousand two hundred dollar payment. The bank called me again a put a stop on the account so they could not keep doing this. So this is still within a month... Then it happened we recieved another letter from ameriquest that we were late. At that time I had had enough... I called numerous lenders and got the best price for refinancing and one week away from closing on the refinancing we recieved numerous offers from all types of finance companies to refinance... Come to find out they were all a ameriquest and sister companies... Surprise surprise... When it came time to close the credit scores dropped due to so many inquiries that we could not refinance.
We spoke to the new company and told them that we recieved alot of these letters and they said that we could still refinance as long as we send a letter of explaination. Well we did that and the loan officer called me and said that our report now showed numerous months past due with ameriquest and because we were 90 days past due we could not refinance... Mind you we were never late... They made it late because they had a computer GLITCH yeah right... So we were forced to go into a foreberance agreement with ameriquest to keep our home... A large amount of money down and huge payments made it almost impossible to do. I did manage to continue with my payments by the grace of god.
Well guess what... They said we did not pay the payments. We wired the payments to them and they said they never received them. So I sent via fax the receipts and they told me I was a liar and they were forged... Wired documentation from a Bank Manager mind you... How could they be forged if they are from the Bank... Well we decided to put the house up for sale... And we entered into a mass action suit against ameriquest for the right to cancel notice. And we in this action with our attorney cancelled our mortgage. Guess what they stopped the sale of our house by turning the title of the mortgage back into their name stated it was a strict foreclosure. We cannot sell it or refinace it and they have totally ruined our lives and our credit.
Our attorney is in court now stopping the proceedures. This is aweful and what a nightmare. My family all thinks we are lying that no bank or mortgage company would be so rotten or vial and they think we have lied about all of this. Well time will tell who will win this... Ameriquest has ruined our lives and our credit. When they went to court with our attorney they tried to produce signed papers that a state marshall said we signed, in 2005. We never received any paperwork from a marshall and the signatures on all of the mortgage documents and this are not our signatures. The american nightmare. We have moved out of that state and are still battling this almost a year later and still cannot sell our house which had alot of equity in it.
And the total amount that they wanted us to agree to pay was almost twice the amount of the orignal mortgage. We were in contact with the banking commissioner during this whole entire time and have all of our receipts of payment and all of the correspondents. We are now renting and still battling this. Please pray that we can recoup some of our losses. They also charged us a fee at closing over eighteen thousand dollars.in forebarrance payments and down payments they managed to milk over forty thousand dollars and we were never late... GOTTA LOVE THAT AMERICAN NIGHTMARE CALLED AMERIQUEST.
